c t <br />CITY OF NORTH OLMSTED <br />• <br />ORDI??ANCE NO. 64-__!jQV__ <br />? <br />, <br />BY ' . <br />A RESOLUTION SUPPORTING THE POSITION OF COUNTY AUDITOR, <br />R,AI,pH J. pERK, IN HIS ATTEMPT TO PROTECT THE HOMEOWNER <br />FROM ANY INCREASE IN TAXES: ALSO REQUESTING THE GOVERNOR <br />TO CALL THE LEGISLATURE INTO SPECIAL SESSION TO TAKE ALL <br />POSSIBLE STEPS NECESSAR;t TO PREVENT THE INCREASE IN R£AL <br />ESTATE TAXES FOR THE H011/IEOWNER WHICH WILL RESULT B°Y THE <br />APPLICATION OF THE RECENT SUPREME COURT DECISION IN THE <br />CASE OF THE STATE EX REL THE PARK INVESTMENT COMPANY <br />VS. THE BOARD OF TAX APPEALS ET AL, AND DECLARING AN <br />EMERGEN CY. <br />WHEREAS, Council has been apprised of the recent Supreme <br />Court decision requiring that residential property be taxed at the same level <br />as commercial property, and <br />WHEREAS, it has been estimated that this could mean up <br />to a 20% increase for the homeowner in the City of North Olmsted, and <br />WHEREAS, such an increase would discourage home owner- <br />? ship and thus destroy the stabilfty of owner-occupied neighborhoods in the <br />City of North Olmsted, and <br />WHEREAS, the record will show that wherever there is a <br />large owner-occupied neighborhood there is less need for police and fire <br />protection, less juvenile delinquency, less crime, and more economic and <br />social stability, and <br />• WHEREAS, this Supreme Court Decision will fall hardest on <br />those least able to pay, such as the senior citizen on a fixed income who <br />scrimps and saves penny by penny to pay his just real estate taxes, and <br />WHEREAS, any increase in taxes will result in a home- <br />owner's defecting all bond issues, regardless of their worth and progress in <br />this community could grind to a halt, and <br />WHEREAS, there must be equalization in real estate taxation <br />within the various classifications of property and not necessarily between them, <br />Section 1: NOW, THEREFORE, BE IT ordained by the <br />Council of the City of North Olmsted, Ohio, that this Council be placed <br />on record as unanimously supporting the position of County Auditor, R81ph J. <br />• Perk, in attempting to appeal the decision of the Supreme Couit and, further <br />in his attempt to bring about a change in the Ohio law to favor homeowners. <br />Section 2: That the Council respectfully request the <br />Governor of Ohio to call the Legislature into special session for the purpose <br />of establishing a Homestead Act, or to provide tn the the law for a classifi- <br />cation of property as either agricultural, residential, commercial or industrial, <br />with a legal percentage of the true value of each classification. The residential <br />snd agricultural classifications should receive favored treatment with a lower <br />tax base. <br />1,i.??
