? <br />CITY OF NORTH OUISTED <br />ORDINANCE N0. 78- /oL <br />BY: ' <br />AN ORDINANCE REGULATING Tf-IE TRANSPORTATION OF <br />RADIOACTIVE MATERIALS THROUGH THE CITY OF NORTH <br />OU7STED. <br />WHEREAS, the nwnber of accidents involving the shipment and transporta- <br />t-on of radioactive materials has increased, including one recently in the <br />Northeastern Ohio area; and <br />WfEREAS, the number of radioactive material shipments is increasing <br />and will continue to increase, according to studies cormnissioned by the <br />United State Government, and <br />WHE?ZEAS, the shipment and transportation of radioactive materials <br />is inherently dangerous, and that any accident resulting therefrom constitutes <br />a health and safety hazard to the irrnnediate community wherein such accident <br />occurs, and <br />WHEREAS, the multitude of federal and state regulatory agencies <br />governing various stages of the shipment and transportation of radioactive <br />materials and disasters in relation thereto, do not adequately prevent the <br />occurrance of such accidents in local communities, and that the confusion in <br />federal and state regulation has rendered it necessary for the City of North <br />Olmsted to supplement present regulations with its own procedure for the shipment <br />and transportation of radioactive materials within the City itself, and <br />Wf-IEREAS, this Ordinance is necessary to preserve the safety, health <br />and welfare of the City of North Olmsted. <br />NOW, THEREFOFtE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLM.STED, COUN'I'Y OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there is hereby adopted certain regulations for the <br />transportation of radioactive materials through the City of North Olmsted which <br />regulations shall be as follows: <br />A. PURPOSE AND DEFINITIONS. <br />l. The purpose of this Ordinance is to provide minimum <br />standards and regulations insuring the safe shipment and <br />transportation of radioactive materials through the City <br />of North Olmsted. <br />2. For the purpose of this Ordinance the following terms, <br />phases, words, and their derivations shall have the <br />meaning given herein. jVhen not inconsistent with the <br />context, words used in the present tense include the <br />future, words used in the plural nwnber include the <br />singular nwnber, and words in the singular number in- <br />clude the plural nwnber. The word "shall" is always <br />mandatory and not merely directory. <br />a. "Radioactive Material" means any material or com- <br />bination of materials, which spontaneously emits ionizing <br />radiation. Materials in which the estimated specific <br />activity is not greater than 0.002 microcuries per gram <br />of material, and in which the radioactivity is essentially <br />uniformly distributed, are not considered to be radioactive <br />materials.
