<br />CITY OF NORTI-I 0I1,11STED <br />ORDINANCE N0. 78-? <br />BY : i??/ G?? .?. • <br />AN ORDINANCE ACCEPTING AN EASaIENT FOR THE <br />INSTALLATION AND MAINTENANCE OF A WATER N1AIN <br />FOR THE PURPOSE OF SUPPLYING WATER SERVICE BY <br />THE CITY OF CLEVELAND TO THE ATLANTIC & PACIFIC <br />TEA COMPANY (A & P). <br />WHEREAS, the Atlantic & Pacific Tea Company (A & P), desires to extend <br />water mains to their store, and <br />Wf-IEREAS, the City of Cleveland reauires that extensions of water lines shall <br />only be approved if easements are granted to both the City of Cleveland and the <br />City of North Olmsted so that water mains may be constructed and maintained therein, <br />and <br />WHEREAS, this Council deems it in the best interest of the City to accept <br />the easement described herein: <br />VOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF TfE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council does hereby accept an easement from the <br />Atlantic & Pacific Tea Company (A & P) for the installation and maintenance of <br />a water main for the purpose of supplying water service by the City of Cleveland <br />into the Atlantic & Pacific Tea Company (A & P) Store, copy of which said easement <br />is attached hereto and made a nart hereof as though fully rewritten herein and <br />ma.rked Exhibit "A". ? <br />SECTION 2: That the Director of Finance is hereby authorized to issue his <br />warrant an p o the Atlantic & Pacific Tea Company (A & P), the sum of One <br />Dollar ($1.00) and other valuable consideration for the granting of this easement. <br />SECTION 3: That the Engineer of the City of North Olmsted is hereby directed <br />to cause sai easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 4: That the Clerk of this Council is hereby authorized to forward <br />a certi ie copy of this Ordinance to the Director of Public Utilities of the <br />City of Cleveland. <br />SECTION 5: That this Ordinance shall take effect and be in force from and <br />after the earliest period allowed by law. <br />PASSED: / ? <br />ATTEST : <br />NORA T.
