<br />INSTALLATION AND MAINTENANCE OF A WATER MAIN IN
<br />'IN TH'E CITY OF NORTH OLMSTED, OHIO
<br />fKNOGd ALL MEN BY THESE PRESENTS: That
<br />the Grantor, herein, for valuable consideration received and to be
<br />Ireceived to our full satisfaction, do hereby give, grant, bargain
<br />and convey to the City of North Olmsted and to the City of Cleve-
<br />land, municipal corporations of the State of Ohio, the Grantees
<br />herein, the perpetual right-o,f-way and easement, for the purpose
<br />hereinafter mentioned in the following described premises, which
<br />easement over premises shall be non exclusive, to wit:
<br />iituated in the City of North Olmsted, County of Cuyahoga and State
<br />Df Ohio, and known as being part of Original Dover Township Lot No.
<br />30 and bounded and described as follows:
<br />3eginning on the Northwesterly line of Lorain Road, 80 feet wide,
<br />it its intersection with the Easterly line of said Original Lot No.
<br />30 which is also the Easterly line of the City of North Olmsted;
<br />'hence N. 00 59' 41"W., along the Easterly line of the City of
<br />forth Olmsted, a distance of 427.19 feet;
<br />'hence S. 890 00' 00" W., a distance of 50.00 feet; ,
<br />hence S. 00 59' 41" E., a distance of 456.29 feet to the North-
<br />esterly line of Lorain Road;
<br />hence N. 580 47' 20" E., along the Northwesterly line of Lorain
<br />oad, a distance of 34.58 feet to an angle point therein;
<br />hence N. 580 49' 36" E., along the Northwesterly line of Lorain
<br />oad, a distance of 23.27 feet to the place of beginning, accord-
<br />ng to a survey by The Henry G. Reitz Engineering Company, dated
<br />ugust, 1977, be the same more or less but subject to all legal
<br />ighways.
<br />Cn consideration of the mutual covenants herein contained, the
<br />irantor hereby gives, grants and conveys unto said Grantees, the
<br />right and easement to enter upon said premises and to lay, install,
<br />-epair, and maintain therein a water main and appurtenances,
<br />Lncluding the installing and maintaining of service Eonnections and
<br />>ipes, setting and maintaining all water meters and the making of
<br />ill repairs to mains, service meters, and all appurtenances con-
<br />iected therewith that in the opinion of the Grantees, their
<br />ouccessors or assigns, may be necessary at any time, also to turn
<br />)ff the water of any service or ma.in, or to do any other thing that
<br />iay be necessary or advisable in the judgement of said Grantees,
<br />heir successors or assigns, in order to maintain or operate said
<br />iain, meters, connections, pipes and appurtenances in accordance
<br />itfi the ordinances, rules and regulations for the management and
<br />rotection of said Grantees now in force or that may hereafter be
<br />dopted. Further, whenever maintenance or work of any kind is
<br />equired hereunder, the Grantees, either jointly or separately,
<br />hall not be responsible for restoration of the property or its
<br />nvirons to its original topographical condition, and should also
<br />e held blameless for any damage accruing by reason of water
<br />eakage from water mains or appurtenances, except that Grantees
<br />hall use reasonable efforts not to intensionally interfere with
<br />rantors business activity.
