S. VACANCIES. <br />Whenever any office of Councilman becomes vacant, the vacancy shall be filled <br />by appointment by a majority vote of the remaining members of Council eligible to <br />vote to serve for the unexpired term or until the election of a successor for the <br />unexpired term at the next regular municipal election, provided that, (a) such <br />election shall occur more than two years prior to the expiration of the unexpired <br />term and (b) the vacancy shall have occurred more than seventy five (75) days <br />prior to the primary election. If Council does not fill said vacancy within <br />thirty (30) days, the Mayor shall appoint a councilman to fill said vacancy. <br />(C) That Section 2 of Article V of the Charter to be amended to rovide for <br />the election o a successox to t e o ice of Director of Law in the event the <br />o lce o Irectox o Law ecomes vacant more than two ears rior to the e ira- <br />tion o t e unexpixe term an moxe than seventy five (75) days prior to the date <br />or t e primarv election, suc amended Section of Article V to read as follows: <br />SEC. 2. DIRECTOR 0F LAW <br />The Director of Law shall be the head of the Law Department of the City <br />and cornmencing with the regular municipal election in the year 1977, and every <br />fourth (4th) yeax thereafter, he shall be elected for a term of four (4) years. <br />His term shall begin and he shall assume o£fice on the first day of January next <br />following such election. The Director of Law shall be eanpotivered to designate <br />such assistants as shall be authorized by and approved by Council. No person <br />shall be eligible ta be the Director o£ Law unless he is authorized to practice <br />as an attorney in Qhio and has been engaged in the active practice of law in <br />Ohio continuously for a period of five years next pxeceding his election, has <br />been a auali£ied elector and a resident of the City for at least two (2) years <br />immediately prior to the date of his election, and shall continue to be a aualified <br />elector and resident of the City during his term of office. <br />In the event the affice of Director of Law shall become vacant for any <br />reas4n, the Mayor shall appoint a successor, subject to confirmation by a majority <br />of the membexs of Cpuncil, tp sexve for the unexpired term or until the election <br />of a successor for the unexpired term at the next regular municipal election <br />provided, that, (a) such election shall occur more than twa (2) years pxipr to <br />the expiration of the unexpired term, and (b) the vacancy shall have accurred <br />more than seventy £ive (75) days prior to the date for the primary election. <br />I£ such vacancy occurs a£ter the filing date the A4ayor shall apppint a successor, <br />subject to canfirmation by a majority af the members of Cauncil. <br />Upon concurrence of two-thirds of the members o£ Council, the Council may, <br />after public hearing, remove the Directax af Law from office for his disqualifica- <br />tion while in of£ice, for his conviction while in office of a crime involving <br />moral turpitude, or for a violation of his oath o£ office. Prior to such removal <br />action, the Directar of Law shall be notified in writing of the charge or charges <br />against him at least ten (10) days in advance of any hearing upon such charge <br />or charges, and he and his caunsel shall be given an opportunity to be heard, <br />pxesent evidence, and examine any witness appearing in support o£ such charge or <br />charges. <br />The Director of Law shall act as legal caunsel and serve in such capacity <br />the Mayor, Council, administrative o£ficers, departments, and the cpmmissians and <br />baards of the City. A$ legal counsel and attorney, he shall repxesent the City <br />in all proceedings in court or before any administrative body and in such other <br />matters and controversies as he is, by resolution or ordinance, directed to <br />prosecute. He or an Assistant Director of Law shall act as Prosecuting Attarney <br />for the City. He shall pexform all other duties now or hereinafter imposed upon <br />city salicitors by the laws of the State of Ohio unless Qtherwise provided by <br />ardinance of the Council and shall perform such duties as Council and the Mayor <br />may impose upon him consistent with his office.
