DIRECTOR OF FINANCE <br />The Director of Finance shall be on a full-time basis, with his office to <br />be conducted from the Municipal Building, and shall be the head of the Finance <br />Department and the Fiscal Officer of the City. Commencing with the regular <br />municipal election in the year 1977, and every fourth (4th) year thereafter, he <br />shall be elected for a term of four (4) years. His term shall begin and he shall <br />assume office on the first day of January next following such election. No person <br />shall be eligible to be the Director of Finance unless he shall have been a <br />qualified elector and resident of the City for at least two (2) years immediately <br />prior to the date of his election, and shall continue to be a aualified elector <br />and resident of the City during his term of office. The Director of Finance <br />shall at the time of his election be either a certified public accountant or a <br />registered public accountant with a minimum of five (5) years public or private <br />accounting experience immediately preceding his election. <br />In the event the office of Director of Finance shall become vacant for any <br />reason, the Mayor shall appoint a successor, subject to confirmation by a majority <br />of the members of Council, to serve for the unexpired term or until the election <br />of a successor for the unexpired term at the next regular municipal election <br />provided that, (a) such election shall occur more than two (2) years prior to the <br />expiration of the unexpired term, and (b) the vacancy shall have occurred more <br />than seventy five (75) days prior to the date for the primary election. <br />Upon concurrence of two-thirds of the members of Council, the Council may, <br />after public hearing, remove the Director of Finance from office for his disquali- <br />fication while in office, for his conviction while in office of a crime involving <br />moral turpitude, or for a violation of his oath of office. Prior to such removal <br />action, the Director of Finance shall be notified in writing of the charge or <br />charges against him at least ten (10) days in advance of any hearing upon such <br />charge or charges and he and his counsel shall be given an opportunity to be heard, <br />present evidence, and examine any witness appearing in support of such charge or <br />charges. <br />He shall serve the Mayor and the Council as finance advisor in connection <br />with municipal affairs, and he may serve as Clerk of Council. In such capacity <br />or capacities, he shall keep the records of said bodies, and shall authenticate <br />all records, documents, and instruments of the City on ivhich authentication is <br />proper. The Director of Finance shall examine all payrolls, bills and other claims <br />against the City and shall issue no warrant unless he shall find that the claim <br />is in proper form, correctly computed and duly approved, and that it is due and <br />payable, and that an appropriation has been made therefor; and he shall perform <br />all other duties now or hereafter imposed upon City Auditors or Treasurers by <br />the laws of the State of Ohio unless otherwise provided by this Charter, or by <br />ordinance of the Council, and he shall perform such other duties as the b7ayor may <br />impose upon him consistent with his office. <br />SECTION 2: That if such amendment <br />voitng t ereon at such election, it shall <br />of its approval by the electors. <br />is approved by a majarity of the electors <br />become effective from and after the time <br />SECTION 3: That the Clerk of Council is hereby authorized and dixected ta <br />cause a copy of the proposed Charter amendment to be published in such manner as <br />may be authorized by law. <br />SECTION 4: That the Clerk of this Council be and he is hereby authorized <br />and directeT to-Torward a certified copy of this ordinance to the Boaxd of Elections <br />of Cuyahoga County. <br />SECTION 5: That the Board of Elections is hereby requested to cause <br />appropriate notice of such election to be duly given in accordance with 1aw. <br />SECTION 6: That it is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this Ordinance were adopted in
