In the event that a full time sworn employee of the Police Department of <br />the City of North Olmsted should be injured while in the line of duty due to a <br />sudden and accidental occurrence and such injury has so incapacitated said member <br />of the Police Department that he is temporarily unable to work, then the Director <br />of Public Safety, after determining that said injury is work related and is of a <br />temporary nature, may authorize full payment of the employee's regular salary <br />for a period of not more than ninety days. If, after said ninety day period, <br />said employee is still temporarily incapacitated, then the Director of Public <br />Safety shall recommend to Council whether or not to continue said salary. <br />Council shall forthwith review the matter and by majority vote determine whether <br />the employee shall continue to receive his full salary during recuperation. <br />For the purposes of this Paragraph, a sudden and accidental injury shall <br />include such incidents as an automobile accident, assault and battery, gun shot <br />would and the like. It shall not be considered as sudden and accidental if injury <br />or incapacity results from the lifting of objects, slipping, tripping or falling, <br />heart failure or heart attack. <br />Any full time sworn employee of the Department who qualifies for benefits <br />under Paragraph 0 hereof shall be required to pay over to the City any amounts <br />received from the Bureau of Workmen's Compensation as supplemental wages. Further, <br />if at any time the City determines, on the basis of inedical evidence, that an <br />employee is permanently disabled and will no longer be able to carry on his duties <br />then the City may terminate payments and insist that the employee go on a pension <br />program. Any employee who qualifies for the benefits under this paragraph shall <br />not have his accumulated sick time reduced because of a qualified accidental injury <br />which occurred while in the line of duty. <br />SECTION 3. That the employees of the Police Department of the City of North <br />Olmsted be reimbursed, not to exceed three dollars ($3.00) per day, for per diem <br />expenses while in attendance at the Police Training School established by the <br />Cuyahoga County Commissioners at Case Western Reserve University, which school is <br />for a two-week period with ten days class attendance. <br />SECTION 4: That the Rules and Regulations established by virtue of the <br />adoption of Ordinance No. 76-157 on November 3, 1976, shall remain in full force <br />and effect and said Rules and Regulations shall be adopted with this Ordinance and <br />the same are made a part hereof by reference. <br />SECTION 5: Except as otherwise provided herein, all other Ordinances or <br />Resolutions, or parts of Ordinances or Resolutions, or parts of Ordinances or <br />Resolutions inconsistent therewith to the provisions of this Ordinance, and <br />expecially Ordinance No. 77-192, are hereby repealed. <br />SECTION 6: That this Ordinance is hereby declared to an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, <br />and for the further reason that it is immediately necessary for the continuity of <br />services of the safety forces of the City, and further provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: <br />ATTEST: ? <br />NORA T.
