-28- <br />the passage of this ordinance, such lot is shown to be a separate and <br />distinct numbered lots or a lot of equal area to the majority of lots <br />within five hundred (500) feet thereof, by a plan of lots which has been <br />recorded or which depicts streets or alleys which have been legally de- <br />dicated to public uses <br />ARTICLE JCV <br />rwr~r.-rw~r~w <br />BOARD OF APPEALS <br />Section 1. CREATION - P~~IBERSHIP <br />(a) A Board of Appeals is hereby established. The word <br />'~Board~~ when used in this ordinance shall be construed to mean the Board <br />of Appeals. <br />(b) The Board shall consist of three members recommended <br />by the l~or and appointed by Council, One member shall be designated to <br />serve until January 1, 1957, and one until January li 1958; and one until <br />January lr 1959. Their successors shall be appointed, on the expiration <br />of their respective terms, to set~ve three yearsi An appointment to fi7.1 a <br />casual vacancy shall be only for the unexpired portion of the terms, <br />Section 2. P~'~T.~.s. Meetings of the Board shall be held <br />at least once a month and at such other times as the ::'Board may determine <br />or upon call of the Chairman. All meetings shall be open to the public. <br />The Board shall adopt its own rules of procedure and shall keep a record <br />of its proceedings showing the vote of each member upon each question, or <br />if absent or failing to vote indicating such fact; and shall keep records <br />of its exaYainations and other official actions. Every rule or regulation <br />every amendnyent or repeal thereof and every order, requirement, decision <br />or determination of the Board shall immediately be filed in the office of <br />the Board and becomes a public record. <br />Section 3. Ate. An appeal from the decision of the <br />Administrative Officer may be made to the Board of Appeals by ar~r person <br />aggrieved or by any officer of the City affected by ar~y decision of the <br />Ac~m3.nistrative Officer. The appelant shall file with the Administrative <br />Officer and with the Board of Appeals a notice of appeal specifying the <br />grounds thereof. Such appeal shall. be taken within a reasonable tame as <br />provided by the rules of the Board by filing wi+,.h the officer from whom i~he <br />appeal is taken and with the Board of Appeals a notice of appeal specifying <br />the grounds thereof. The Administrative Officer shall forthwith transmit <br />to the Board all. papers constituting the record upon which the action <br /> <br />
