It shall be u~tawful to <br />erect, or use ~rilling r~i.g within qne hundred fifty {150 feet of <br />an inhabitable dwelling in the City of_Di~rth Olmsted, withc~t-first <br />obtaining in writing the consent of all the owners of dwellings within <br />that radius as measured from the center of the proposed. well, every <br />drilling rig shall bR equipped with a fire extinguisher maintained in <br />good condition; It shall be furhter unlawful to drill any .gas or oil <br />well, or to extend or deepen one already drilled within one hundred <br />fifty (150) feet of any railroad right-of-way, street or highway as <br />measured from the center of the proposed well to the nearest point of <br />the right-of-way or dedicated portion of the street or highway...: <br />The Building Commissioner shall make such inspections. <br />Section REJECTION OF APPLICATION. The Planning C4mmi.ssion <br />of the City-~u~t2~ C?lmsted shall have the-right to recommend rejection <br />of say application for a permit where by reasoh:of the location of the <br />proposed well and the character and value of the permanent iteprovements <br />already erected, and the use to which the land and surroundsngs are <br />adapted for civic purposes, or for sanitary reasons the drilling of an <br />oil or gas well will constitute a serious disadvantage to the City and <br />its inhabitants. When a permit is refused, the deposit of ~.sh required. <br />to be made with the application shall be returned to the applicant, <br />Appeal from the denial of a permit shall be to the Hoard of Appeals as <br />provided in Article gTII, Section 3 of the Zoning Ordinance of the City <br />of North Olmsted, Ohio, passed March 3, 1953• <br />S.®cti.on 10. CONTROL GATE. It shall be the duty of any person, <br />firm or corparatie~n -~.n the drilling of a well, or the cleaning of an <br />abandoned well preparatory to the plugging of said abandoned well, to <br />provide for adrilling-in control gate which shall be so constructed as <br />to effectually cut off the flow of gas to the top of the well and v~~ich: <br />Qas~be operated at a remote point from the well. <br />' Sec-?. 11 ABANDONMENT OF WELL.
