VARA3~Y SUBDIVISION TO BE ?AID PRIOR TO DEVELOPMENT OF SAID LANDS FOR THE PRIVILEGE OF CONNECTION OF STOR~1 DRAINAGE FROA~ SAID LANDS INTO AN EXCESS SIZE STORM SEWER OUTLET INSTALLEL! BY THE LORAIN MUTUAL INVESTMENT COMPANY FFt.OM THE SOUTHERN BOUN~IARY OF THE MICHAEL M. VARADY SUBDIVISION TO 'THE CITY' S STORM SEt+~~ER T:~1 BROOKPARK ROAD, AND DECLARING AN EMERGENCY. WHEREAS, as a condition precedent to the approval of the plat of the Lorain Mutual Investment Companyts Michael M, Varady Subdivision the Planning Commission and Council of this City, upon the advice of the city engineer, required the installa- tion of an excess size storm sewer outlet from a point in the Southerly prolongation of Michael Avenue, 85 feet Northerly of the centerline of Brookpark Road; thence, Westerly parallel to Brook- park Road about 465 feet , of 30't Reinforced Concrete Pipe to a manhole at the Southerly prolongation of Georgette Avenue; thence, Southwesterly about 97 feet of 42tt Reinforced Concrete Pipe to a manhole in the centerline of Brookpark Road. WHEREAS, the installation of this excess size s~arm sewer outlet was required in order that land lying to the east of the Michael M. Varady Subdivision could and would be required upon development thereof to connect storm drainage from said lands into this outlet and thus the owners of the lands and the City would be assured of adequate storm drainage for the whole area; and WHEREAS, said storm sewer outlet was larger and more costly to install than a storm sewer outlet which would drain the Michael M. Varady Subdivision lands and the Lorain Mutual In- vestment Company agreed to install and pay for the same providing that the City would establish a connection charge to be paid by the owners of various parcels of land which would drain into said outlets with such charges to be paid when and if development of such lands occurred in order that the Lorain Mutual Investment Comt?any would be reimbursed for the a~r~ount determined by the City Engineer to be excess cost; and WHEREAS, the City Engineer has computed the amount of the excess cost at ~5,806.C?0 and has determined that 11.8 acres "" of land to the east will, ut~on development, connect into said „,~ storm sewer outlet and be drained thereby; and WHEREAS, this Council desires to provide that when. and if such lands are developed that the developers thereof shall pay their fair share of the cost of installn said excess storm sewer outlet and to reimburse the Lorain Mutual Investment Company out of such payments as received.
