Ordinance No. 63 Page 2 Section 1 That the Planning Commission, the City Engineer, Department of Fublic Service and this Council shall refuse to accept plans for the development of the lands described in Section 2 hereof until there has been paid to the Director of Finance the sum of $490.59 per acre for the excess sized storm sewer outlet referred to in the recitals herein. The Director of Finance shall cause such sum or sums paid hereunder to be paid to the Lorain Mutual Investment Company, its successors and assigns. Section 2 That the lands which are subject to the provisions of Se ctionRl, with permanent parcel numbers, names of present owners, acreage and the amount of the connection charge for each parcel computed at a rate of $490.59 per acre is as follows: Perm. That the development of the lands shown in Section 2 hereof, which is less than the entire area, shall make provision for the drainage of the balance thereof as determined by the City Engineer. Section 4; That the failure of the City or its agents to collect the money herein provided for or to pay it to the proper firm or person, if in good faith, shall not render the City or its agents liable to anyone. In the event the Director of Finance or his successor shall be unable to determine the firm or person entitled to receive the money collected hereunder he shall notify those parties whom he believes will be entitled thereto and hold such fund until a Court of proper jurisdiction orders it paid.
