Ordinance No. 63 <br />Page 2 <br />Section 1 That the Planning Commission, the City <br />Engineer, Department of Fublic Service and this Council shall <br />refuse to accept plans for the development of the lands described <br />in Section 2 hereof until there has been paid to the Director of <br />Finance the sum of $490.59 per acre for the excess sized storm <br />sewer outlet referred to in the recitals herein. The Director of <br />Finance shall cause such sum or sums paid hereunder to be paid to <br />the Lorain Mutual Investment Company, its successors and assigns. <br />Section 2 That the lands which are subject to the <br />provisions of Se ctionRl, with permanent parcel numbers, names of <br />present owners, acreage and the amount of the connection charge <br />for each parcel computed at a rate of $490.59 per acre is as follows: <br />Perm. That the development of the lands shown in <br />Section 2 hereof, which is less than the entire area, shall make <br />provision for the drainage of the balance thereof as determined by <br />the City Engineer. <br />Section 4; That the failure of the City or its agents to <br />collect the money herein provided for or to pay it to the proper firm <br />or person, if in good faith, shall not render the City or its agents <br />liable to anyone.
