~~ All as shown on the plans hereinafter referred to, prepared by the City`s Consulting Engineers. Said sewers are to comprise a sewage collection system for territory known as "Area 3" of the City of North ©lmsted and are to connect into a trunk line sewer to be constructed z.n public easements and running from a point in Barton Road approximately 56~ feet south of its intersection with Lorain Road easterly about 2,©9Q feet and thence northerly abaut 71,2 feet, and an interceptor sewer to be constructed i.n public easements and existing streets from a point approximately 1,395 feet west of Stearns Road, thence easterly, intersecting Stearns Road about 2,$13 feet south from Lorain Road, to Columbia Road and thence northeasterly to Parklane, also as shown on said plans. Such trunk sewer and intercepting sewer are to be paid for by the City and are not to be assessed. Section 2. It is hereby determined and declared that said improvement is conducive to the public health, convenience and welfare of said City and the inhabitants thereof. Council further finds and determines that said streets, or parts thereof, to be sa improved are so situated in re]~ation to each other that in order to complete the improvement thereof in the most practical and economical manner they shall be improved at the same time, with the same kind of materials, and in the same manner. Section 3. That the grade of said streets and improvement shall be the grade as shown by said Engineers' plans and profiles which are made a part hereof. Section ~+. That the plans, specifications, estimates and profiles of the proposed improvement, heretofore prepared by the Engiers, and now on file in the office of the Clerk of this Council, are hereby approved. Section 5. That the whole cost of said improvement, less at least one-fiftieth thereof and the cost of all intersections, shall be assessed upon the following described lots and lands in proportion to the benefits resulting therefrom, to-wit; A11 lots and lands bounding and abutting upon the proposed improvement between the termini aforesaid, except that with respect to the Southern Avenue sewers (item 13 of Section 1), the lots and lands to be assessed shall be those only which abut on the south side thereoi', which said lots and lands are hereby determined to be specially benefited by said improvement; and the cast of said improvement sha,1.1 include the cost of preliminary and other surveys, plans, specifications, profiles and estimates, and of printing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the interest thereon, the casts incurred in connection with the preparation, levy and collection of the special assessments, the cost of purchasing, appropri- ating and otherwise acquiring therefor any required real estate or interests therein, expenses of legal services including obtaining an approving legal opinion, cost of labor and material, and interest on bonds and notes issued in anticipation of the levy and collection of the special assessments, together with all other necessary expenditures. 2
