G~- z-~ ~ <br />(16a) In public easement ad.,~acent to and parallel with the south <br />right of way line of Lorain Road, from a point 255 feet west <br />of Barton Road easterly to Porter Road; <br />(16b) 2n the north right of way of Lorain Boulevard from Barton Road <br />easterly to West Park Drive; <br />(17) Barton Road from Lorain Road southerly to a point 1200 feet north <br />of South Corporation Line; <br />All as shown on the plans hereinafter referred to, prepared by the Cityts Consulting <br />Engineers. Said sewers are to compxise a sewage collection system for territory <br />known as "Area 3" of the City of North Olmsted and are to connect into a trunk line <br />sewer to be constructed in public easements and running from a point in Barton Road <br />approximately 5~F feet south of its intersection with Loraa.n Road easterly about <br />2090 feet and thence northerly about 712 feet, and an interceptor sewer to be constructed <br />in public easements and existing streets from a point approximately 1395 feet west of <br />Stearns Road, thence easterly, intersecting Stearns Road about 2813 feet south from <br />Lorain Road, to Columbia Road and thence northeasterly to Parklane, also as shown on <br />said plans. Such trunk sewer and intercepting sewer are to be paid far by the City and <br />are not to be assessed. <br />Section 2. It is hereby determined and declared that said improvement is conducive <br />to the public health, convenience and welfare of said City and the inhabitants thereof. <br />Council further finds and determines that said streets, or parts thereof, to be so <br />improved are so situated in relation to each othex that in order to complete the <br />improvement thereof in the most practical and economical manner they shall be improved <br />at the same time, with the same kind of materials, and in the same manner. <br />Section 3. That the grade of said streets and improvement shall be the grade <br />as shown by said Engineers' plans and profi~,~s which. are made a part hereof. <br />Section 4. That the plans, specifications, estimates and profiles of the <br />proposed improvement, heretofore prepared by the Engineers, and now on file in the <br />office of the Clerk of this Council, are hereby approved. <br />Section 5. That the whole cost of said improvement, less at least one-fiftieth <br />thereof and the cost of all. intersections, shall. be assessed upon the following described <br />lots and lands in proportion to the benefits resulting therefrom, to-wit: <br />All lots and lands bounding and abutting upon the proposed improvement between <br />the termini aforesaid, except that with respect to the Southern Avenue sewers (item 13 <br />of Section 1), the Lots and lands to be assessed shall be those only which abut on <br />the south side thereof, which said lots and lands are hereby determined to be specially <br />benefited by said improvement; and the cost of said ittrprovement shall include the cost <br />of preliminary and other surveys, plans, specifications, profiles and estimates, <br />and of printing, serving and publishing notices, resolutions and ordinances, the <br />2 <br />
