CITY OF NORTH OLMSTED <br />ORDINANCE No. 64 "'/~ <br /> <br />AN ORDINANCE AMENDING AND RBPEALING ORDINANCE 62-163, <br />,~ ENACTED OCTOBER 16, 1962, AND ACCEPTING FROM TH$ <br />STANDARD OIL COMPANY OF OHIO A PERPETUAL EASEMENT <br />OVER GERTAiN LAND ABUTTING ON WHITSTHORN AVENUE, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, ©rdinance b2-ib3, passed on October lb, <br />x.962, authorized the acceptance of a warranty deed from The <br />Standard Oil Company of Ohio cowering certain land abutting on <br />Whitethorn Avenue in the City of North Olmsted, which was essential <br />to the purposed widening of the right-of-way of said Nlhitethorn <br />Avenue, and the installation therein of sidewalks; and <br />WHEREAS, negotiations with The Standard Oil Company <br />of Ohio disclose that an easement in perpetuity over said land <br />for sidewalk, road and municipal purposes would accomplish the <br />same purpose for the City; and <br />MH BRBAS, said perpetual easement has been delivered <br />and it is necessary to amend Ordinance 62-163 to provide for the <br />acceptance of said easement. <br />NOW, THERBFORE, BE IT ORDAINED by the Council of <br />the Gity of North Olmsted, State of Ohio: <br />Section 1: That Ordinance b2-ib3, reading as <br />follows: <br />"Section l: That the City of North Olmsted accept <br />from The Standard Oil Company of Ohio its warranty deed <br />conveying to the City of North Olmsted the parcel of <br />land described in Resolution No. b2-152 and designated <br />as Parcel No. 2 f or the City's use in widening the <br />right of way of Whitethorn Avenue so as to permit the <br />installation of sidewalks. <br />Section 2: That the City of North Olmsted assume: <br /> <br />(a) The cost of the title guarantee. <br />(b) The cost of revenue stamps on the deed. <br />(c) Takes, general and special, for the year 1962. <br />(d) The entire cost of installing sidewalks over <br />said land and over the remaining portion of <br />the land of The Standard Oil Company of Ohio <br />which fronts on Whitethorn ~renue. <br />Section 3: That the Director of Finance <br />hereby authorized to pay for the expenses in <br />and charge the same to the city's portion of <br />Fund. <br />be and he is <br />Item 2 hereof <br />Sidewalks <br />Section 4: That this Ordinance is hereby determined to <br />be an emergency measure necessary for the preservation of the <br />public health, safety and welfare and that such emergency <br />exists by virtue of the necessity of widening Whitethorn <br />Avenue in order to install sidewalks thereon; WH,BREFORE, <br />this Ordinance shall take effect and be in force immediately <br />upon Sts passage, otherwise, at the earliest period allowed <br />by 1aw." <br />be and the same is hereby amended to read as follows: <br />...., . <br />
