<br />In addition to the fines above designated, any person found
<br />guilty of a violation of any weight provision of this Code may
<br />be imprlsioned for not more than six {6} months .
<br />(B) However, no penalty prescribed in this section shall
<br />be imposed on any vehicle combination if (1) , the overload
<br />on any axle does not exceed 1,000 pounds, and if {2), the
<br />immediately preceding or following axle, excepting the front
<br />axle of the vehicle combination, is underloaded by the same or
<br />a greater amount. For purposes of this subsection, two axles
<br />on one vehicle less than eight feet apart shall be considered as
<br />one axle .

<br />Section 7: That Section 301.42 and Section 339.06 {formerly
<br />Section 339.03) of the Codified Ordinances of the City of North Olmsted in
<br />any Ordinance or Resolutions or partsof Ordinances or parts of Resolutions
<br />inconsistent or in conflict herewith are hereby repealed with the effective
<br />date of this Ordinance.
<br />Section 8: That this Ordinance is hereby declared to be
<br />an emergency measure necessary for the immediate preservation of the publi:,
