~.. <br />~ GITY OF NORTH OLMSTED <br />c:~7RD,NANCE NO. 66- 0©~ <br />BY ~~,'L <br />AN ORDINANCE TO PROVIDE FOR THE DRAINAC~=F <br />OF' SURFACE WATER <br />WHEREAS, lands within the City of NcrGh Olmsted have collected <br />water, thereby creating stagnant w°ater conditions incurious to tt~e health c>f <br />the residents of the City of North Olmsted; and <br />WHEREAS, surface water has become a nuisance an:~ prejudicial <br />to the health, safety and welfare of the residents and inhabitants of the <br />City of North Olmsted, Ohio; and <br />W:-IEREAS, this Council deems it necessary to provide for the <br />drainage of surface water on private as well as public property, to prevent <br />and abate such nuisance from occurring, particularly ryut not lirnited to new <br />developments and on parcels of land on which new construction is ta:kine~ <br />placed and <br />WHEREAS, Council wishes to establish procedures and guidelines <br />to be followed by builders, homeowners and developers for the establishment <br />and maintenance of grades within the City of North Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City cif <br />North Olmsted, State of Ohio; <br />Definitions <br />Section l; That, for the purposes of this ordinance, the following <br />items, phrases, words and their derivatives shall have the meaning given in <br />this section; <br />® a. '"Natural Grade'" is the elevation of the undisturbed surface <br />of the ground before the start of construction, <br />b. "Finished Grade" is the new final elevation of the ground <br />surface. <br />c. "Established Grade"' is the finished grade as shown on an <br />improvement plan or grading plan approved by the City <br />Engineer, <br />_Finish Grade at Sidewalk, curb or Street, etc. <br />Section 2; The elevations of the street, curb, sidewalk, or <br />alley shall be the finished grade elevation at that line, when a to*_ or plat <br />of ground is graded . <br />Owner's duty to crrade to adloinina lot grade <br />Section 3: When a l.ot or section of ground is graded it shall be <br />encumbent upon the owner of said lot to provide that said lot be graded to the <br />natural grade of the lots adjoining said lot on both Sides and to the lot in <br />the rear of said lot and in such a manner that surface waters do not drain <br />onto the aforesaid adjoining lots or lands. <br /> <br /> <br />~.~~~at;, ~ as . . <br />
