<br /> <br />CITY OF NORT~ri OLMSTEl~ C}c2JINANCE NO. 6E- l4~ FADE <br />Duty to drainage protection to adjoining lots <br />Section 4: When it is found necessary to grade a lot higher or Io~~rer <br />finished grade than the natural grade of adjoining pr~_~perty orz the sides and to <br />the rear of said lot it: shall be incumbent upon the nwners r=f said l~~t to get <br />permission from the City Engineer of the City of North Olmsted to ;;hangs to a <br />higher or lower finished grade and it shall further be incumbent upon the owner <br />of the said lot to provide suitable retaining wails or other approved protection: <br />on his prnpe~y to protect the adjacent property from the draining of surface <br />waters and further too protect the adjacent property from caving of earth and. <br />to assist in the maintaining of the existing natural grade of such adjacent <br />property. <br />e Hard surfaced areas drainage <br />Section S: That whenever the surface of a lot o~ plot is excavated, <br />filledt graded or hard-surfaced with impervious material positive drainage <br />shall be provided so that a nuisance will not be created. Catch basins properly <br />connected to storm sewers or other approved provisions, such as under-drains, <br />shall be made where water may pocket, to preclude the accumulation of surface <br />water. Surface water shall r+_ot be drained onto adjacent properties not in the <br />same ownership without written permission from the owner of the adj acent <br />property, and existing natural ground drainage of the grourxd area surrounding <br />the lot or plot excavated, filled or graded shall not be impeded. <br />Water Accumulation <br />Section b: That no condition shall be created, nor any existing <br />condition maintained whereby there will be upon any lot or plot excavations, <br />depressions, pits, holes, gullies, or similar depressions which may accumulate <br />and retain surface water and which may become a public hazard or nuisance, <br />Topo rg aphic Map Required <br />Section 7: That no building permit shall be issued until the <br />topographic map for the subdivision or similar plan for the parcel has been <br />approved by the City Engineer. <br />Grades an dedicated streets within. the CitYof North Olmsted <br />Section 8: That on a dedicated street within the Gity of North <br />Olmsted no person, firm or corporation shall be issued a building permit for <br />the construction of any structure until a $300.00 cash deposit is paid to the <br />Building Commissioner to cover administrative costs, costs of checking grades <br />and drainage of surface water. With the exception of. $25.00 which shall be <br />retained by the City as a fee, the balarrce of said cash deposit shall be refunded <br />upon compliance with the terms of this ordinance after deducting therefrom anti, <br />costs and expenses incurred by the City as a result of work done by the City <br />Engineer. <br />In cases involving commercial or multi-family property only, the <br />City may require a deposit greater than the 5300.00, or a bond in said greater <br />amount, to guarantee such complaance. The amount thereof shall be determined <br />by the City Engineer, which determination shall be based upon the estimated <br />cost of performing such drainage wank. <br />If the aforesaid wtrk is not done within thirty (301 days from the time <br />of the sending of written notice by the City of North.Olmsted, the City may dc; <br />the work and the aforesaid cash deposit shall be applied to the cost of the <br />City doing the aforesaid grading and any funds which are ir: excess of the City`s <br />cost of grading shall be returned to the person making the deposit as aforesaidp <br />and further, any deficiency in funds between tree deposit and the cost of the <br />City doing the grading, shall Y~ecome a lien on the lands and shall be certified <br />to the Auditor of Cuyahoga County for entering upon ,the tax duplicate and <br />collection as other taxes and shall be retumed by the Auditor of Cuyahoga County <br />to the City far deposit in the General Fund of the City of N~°~rth Ol~~sted. <br />,. ~r~~T.,.~+r, c <br />
