Ordinance No. <br />.................. /: -= k.� -rtht�lW* <br />i , 1e pf tkxv Villugt vz Nv t <br />An Ordinance <br />Determining to proceed with the improvement of Burns Road for the entire <br />length of said road by grading, draining and constructing along and upon <br />both sides of Burns Road, a sawed sandstone. or , concrete sidewalk., accord- <br />ing to plans and specifications therefor. <br />Be it ordained by the Council of the Village of North Olmsted , State <br />of Ohio, three- fourths of all members elected thereto being presen and <br />concurring: - <br />Section 1.. That it is the intention of the Council and it is hereby <br />determined to proceed with the improvement of Burns Road for its <br />entire length - in the Village of North Olmsted <br />by grading, draining and constructing along and upon both.sidew of said road, <br />s weds gtons sidewa k lag 1 nc es c ess r concrete sidewalk 4 to be the widt test . i <br />ones and in accordance with the plans and specifications prepared by the Engineer <br />and on file ,in the Clerkts office ,and Resolution No. 323 duly. adopted <br />on the 21 day of August <br />Section 2. That all claims for damages resulting therefrom shall be <br />judicially inquired into after the completion of the proposed improvement. <br />Section 3. That the following lots and lands shall be assessed for <br />said improvement as above determined, to wit : - Each lot and parcel of land <br />bounding and abutting upon said improvement in proportion to the entire <br />cost as the assessable foot frontage of each said lot and parcel of land <br />is to the entire assessable frontage. } <br />Section 4* That the whole cost of said improvement less one- fiftieth <br />(150) thereof, and the cost of intersection shall be assessed by the foot <br />front upon the lots and lands bounding and abutting upon said Burns <br />Road forlits entire length which said lots and lands are hereby <br />e ermine o be especially benefited by said improvement; and the cost <br />of said improvement shall include the expense of the preliminary and other <br />surveys of engineering, inspecting and legal expenses; of printing and <br />publishing the notices; the cost of construction; together with interest <br />on notes and /or bonds issued in anticipation of the collection of deferred <br />assessments; all expenses in connection with the issuing and selling such <br />j notes and /or bonds, and all other necessary expenditures. <br />Section 5. That the assessments to be levied shall be paid in ten <br />10 annual installments, with interest on deferred paymen s,, pro- <br />vided that the owner of any property assessed, may at his option pay such <br />assessment in cash within thirty (30) days from and after the passage of <br />the assessing Ordinance, in which case said cash assessment shall not in- <br />clude any item of interest upon notes and/or bonds to be issued in anti- <br />cipation of the collection of deferred installments of. assessments. <br />Section 6. That the notes and/or bonds of the Village of North Olmsted <br />shall be issued in anticipation of the collection of the assessments by <br />installments and in an amount equal thereto. <br />Section 7. That the remainder of the entire 'cast of said improvement <br />not especially assessed, including the cost of intersection together with <br />the cost of any'real estate or interest therein, purchased or appropriated <br />and the cost and expense of any appropriation proceeding therefor and the <br />damage awarded any avner of adjoining lands, and interest thereon and the <br />cost and expense of any such awards, shall be paid out of the public ser- <br />vice fund, or a fund, provided for such purpose, and in the manner provided <br />by law. <br />
