<br />An Ordinance
<br />Prohibiting the carrying on e.nd °conduoting of the-business of selling goods,
<br />wares and merchandise upon certain piAklic streets' of the Village of North
<br />Olmsted by means of trolling storest or ttraveling storest and declaring that
<br />it is necessary that said ordinance shall-become effective at the earliest
<br />date allavwed by law, in order to preserve the public peace, property, health
<br />and safety, inasmuch as the use and occupancy of said streets by said Frollino
<br />or.traveling stores' creates a nuisance in the pbblic streets,.inereases the'
<br />congestion and traffic hazard and renders more difficult the enforcement of
<br />the public health ordinance and laws governing and controlling; the handling
<br />of food products.
<br />Be it• ordained by the Council -of the Village-of,North Olmsted, County
<br />of Cuyahoga and State of Ohio; -
<br />Section it The,term trolling stores or 'traveling Store' is hereby
<br />defined to be and declared to include any store or collection of goods, wares,
<br />products or merchandise which'r+ay be'built or maintained upon any automobile,
<br />or other motor vehicle, motor truck or trackless motor.vehicle, or any other
<br />conveyance desired to permit the public to enter for the.purpose of.buying or
<br />designed for the purpose of conducting therein a retail business upon the
<br />public streets, and within which. are carried or displayed for the purpose of
<br />.offering for sale.or selling,.a stock of goods, or any part thereof, consist -
<br />!ng of different kinds- grades 'or,varieties of goods, wares, produce or mar-
<br />s
<br />chandise,, which store is designed to be moved from place to place over the
<br />public streets _for-the . purpose.of engaging'in and-carrying on a "retail store
<br />business upon and within such public streets.
<br />Section 2. It is hereby declared to be unlawful for any parson, partner-
<br />ship or "corporation, either as principal,, agent or employee, to use or occupy
<br />any street, alley or other public ground.writhin the corporate limits of the
<br />Village of North Olmsted, Ohio,' with, any tooling or traveling store'. as herein
<br />defined , for the purpose ,of selling or offering for sale goods, wares or mer-
<br />chan.d.i s e . r
<br />Section 3. That in case any section or sections of any part of any sec-
<br />tion or sections of this ordinance shall be held to be unconstitutional or
<br />invalid,.then remainder of.the ordinance shall not bethereby made invalid,
<br />but shall remain in full force and -effect,
<br />Section 4. Any person, firm or corporation and the officers, agents and
<br />employes thereof, who ,violates any of the provisions of this ordinance, shall
<br />be guilty of a misdeamenor, and upon conviction- thereof, shall be.fined' not
<br />less than Ten.Dollars (;10.00) or more than Five hundred Dollars (:1,500 *00)
<br />and each day's . violation shall be held and deened to be a separate and
<br />distinct offense.
<br />Section 5, hll ordinances or parts of ordinances in conflict with this
<br />ordinance in so far as they conflict, are hereby repealed.
<br />Section 6. This ordinance is hereby declared to be an emorgeney measure
<br />and shall be in full force and effect from and after its is ssa ge and approval
<br />by the Mayor, and declaring that it is necessary that said ordinance shd l
<br />become effective at the earliest date allowed by law in order to preserve the
<br />public peace, properi.:l, healt]i and safety, inasmuch as the use and ocoupan.oy .
<br />of said streets by_said trolling or tre�veling stores' creates a nuisance in
<br />the public streets, increases the congestion and`-traffic hazard and renders
<br />more difficult the enforcement of the public health ordinances and lows govern
<br />ins and controlling the handling of food products.
