ORDINANCE r10. <br />r9FL 7'ZZR <br />An,.ordinance granting_to The Cleveland <br />°'Electric'Illuminating ,Company, its - successors' <br />-and assigns; the-right to erect,-'construct,--- <br />maintain and use the-necessary poles; i res, <br />conduits and such other fixtures and appliances, <br />overhead and underground, as may be deemed �y it <br />or them necessary or essential to enable it or <br />them'to transmit electricity...through -and- along -. - -' <br />the streets, alleys, highways and public places <br />of the Village of North Olmsted, Ohio, for the <br />purpose of furnishing and supplying electric <br />service. <br />BE IT ORDAINED BY THE COUNCIL OF-- THE - VILLAGE; OF NORTH- OLVZTED,. . . <br />STATE OF OHIO:- +. <br />SECTION 1: That the Cleveland Electric Illuminating Company, its <br />successors and - assigns, be- and- .it -or they are hereby granted the right <br />to erect, construct, "maintain and use the necessary poles, wires, conduits <br />and such other fixtures and appliances, overhead and underground, as may <br />be deemed by it or them necessary or essential to enable it or them to <br />transmit electricity through and along the streets, alleys, highways and <br />public places of the Village of North Olmsted, for the purpose of furnishing <br />and supplying electric service. <br />SECTION 2: The location of all poles, piers or supports shall be <br />subject to the control of the Council of the Village of North Olmsted, and <br />shall be changed by The Cleveland Electric Illuminating'Company, its <br />successors and assigns, to such other locations as may be directed, whenever <br />in the opinion of the Council, the best interests of the Village and the <br />general public demand the moving of the same. No work shall be done here- <br />under except upon permits issued by the Clerk of the Village. <br />SECTION 3. The Cleveland Electric Illuminating Company, its suc- <br />cessors and assigns, shall protect and indemnify the Village of North <br />Olmsted against any and-all claims for damages which may in any way arise <br />from the exercise of the rights and privileges herein granted. <br />SECTION 4: The continuance of the rights and privileges herein <br />granted are hereby expressly made conditional upon the compliance on the <br />part of The Cleveland Electric Illuminating Company, its successors or <br />assigns, with the terms and conditions: of this ordinance, and-the failure <br />to comply with such terms and conditions shall constitute the surrender of <br />such rights and privileges.
