Cacrk ut tt,c xll��;•s vt r:u,'tl, t)liu".t,;il U ±,:..i <br />An Ordinance <br />Determining to proceed with the improvement of Virginia Avenue from Claque <br />Road to the westerly line of the "Ditch, by grading, draining and slagging <br />same. <br />Be it ordained by the Council of the Village of North Olmsted , State <br />of Ohio, three- fo,xrths of all members elected thereto ez.ng presen and <br />concurring:- <br />Section 1. That it is the intention of the Council and it is hereby <br />determined to proceed with the improvement of Virginia Avenue from Clague <br />Road to the w.eaterly line of the YDitch in the Village of North Olmsted <br />by grading, draining and slagging same <br />and in <br />accordance with the <br />plans <br />and specifications prepared by the Engineer <br />and on <br />file in the Clerk's <br />office <br />and Resolution No. 381 duly adopted <br />on the <br />5 day of April <br />, 19 29 . <br />Section 2. That all claims for damages resulting therefrom shall be <br />judicially inquired into after the completion of the proposed improvement. <br />Section 3. That the following lots and lands shall be assessed for <br />said improvement'as above determined, to wit : - Each lot and parcel of land <br />bounding and abutting upon said improvement in proportion to the entire <br />cost as the assessable foot frontage of each said lot and parcel of land <br />is to the entire assessable frontage. <br />Section 4. That the whole cost of said improvementt�txax <br />�c35cQxeadk�cxs }srecxss�Cxaitxiaxksaaza� shall be assessed by the foot <br />front upon the lots and lands bounding and "abutting upon said <br />Virginia Avenue which said lots and lands are hereby <br />determined o be especially benefited by said improvement; and the cost <br />of said improvement shall include the expense of the preliminary and other <br />surveys of engineering, inspecting and legal expenses; of printing and <br />publishing the notices; the cost of construction; together with interest <br />on notes and /or bonds issued in anticipation of the collection of deferred <br />assessments; all expenses in connection with the issuing and selling such <br />notes and /or bonds, and all other necessary expenditures. <br />Section 5. That the assessments to be levied shall be paid in ten <br />(LO) • semi- annual installments, with interest on deferred payments, pro- <br />vided that Ehe owner of any property assessed, may at his option pay such <br />assessment in cash within thirty (30) days from and after the passage of <br />the assessing Ordinance, in which case said cash assessment shall not in- <br />clude any item of interest upon notes and /or bonds to be issued in anti- <br />cipation of the collection of ,deferred installments of assessments. <br />Section 6.
