Ordinance No.� y <br />By Mr. <br />AN ORDINANCE <br />REQUIRING A PERMIT FOR OPENING STREETS AND A DEPOSIT TO PAY <br />THE COST OF REPAVING AND RESTORING STREET TO ITS ORIGINAL CONDITION. <br />BE IT ORDAINED by the Council of the Village of <br />r North Olmsted, State of Ohio: <br />Section 10 No person, firm or corporation shall <br />make any opening or remove any pavement in any streets, <br />boulevards, avenues or public places in the Village of North <br />Olmsted until such person shall file with the Mayor of the <br />Village a written or printed application setting forth and <br />indicating thereon the location, kind and extent of the pave - <br />ment desired to be taken up, the number, purpose and size of <br />r <br />openings or excavations which are desired or necessary. The <br />applicant shall pay to the Village of North..Olmsted $3,00 for <br />the General Fund before the permit is issued and shall deposit <br />with the Village an additional amount sufficient to cover the <br />cost of repairing and relaying the said pavement to be removed, <br />together with the cost of any new material required, plus <br />fifteen per cent (15 %) for the cost of inspection and general <br />supervision, as the same'shall be estimated by the Mayor. <br />Section 2. After the deposit herein required has <br />been made, the Mayor shall issue the permit applied for. <br />Said permit shall state the exact time when the opening or <br />excavation is to be made, the probable length of time required <br />for doing the work and the making of the repair, the character <br />of the pavement, including its base, and the character of the <br />ti work necessary for the satisfactory relaying of the pavement. <br />It shall be the duty of the Village itself to relay the pave- <br />ment, either temporarily or permanently, as may be determined <br />,t by the Mayor. <br />Section 3. When such work is completed and the <br />pavement relaid, the Mayor will determine the cost of the work <br />of relaying the pavement, together with the cost of new <br />materials required and the cost of inspection and supervision, <br />as the case may be, which amount shall be deducted from the <br />deposit made by the applicant and the Clerk shall issue a check <br />to the applicant for the return of the excess over and above <br />the amount necessary to reimburse the Village for the expense <br />of relaying the pavement, together with the cost of new <br />material and supervision. <br />Section 4. -.If the deposit be insufficient to re- <br />imburse the Village, the Mayor shall collect from the applicant <br />a sufficient amount to reimburse the Village for the expense <br />incurred. <br />Section 5. If the application is for a permit to <br />open the street in what.is known as the "tree lawn, 11 then <br />the applicant shall make the 3.00 payment for a permit and <br />shall deposit with the Clerk 815,00 . per square. yard based on <br />the size of the opening, as a guarantee that he will restore <br />the street to its original condition or pay the Village for <br />restoring the same., which deposit, less the cost of inspection, <br />shall be returned to the person, firm or corporation who made <br />the same when a certificate is issued by the Village Engineer <br />that the street has been restored to the same condition as <br />before the opening was made. <br />Section 6. Any person, firm or corporation who <br />shall make any openings or remove the pavement in any street, <br />boulevard, avenue or public ground of the Village of North <br />F <br />f <br />i <br />
