Ordinance No.� y By Mr. AN ORDINANCE REQUIRING A PERMIT FOR OPENING STREETS AND A DEPOSIT TO PAY THE COST OF REPAVING AND RESTORING STREET TO ITS ORIGINAL CONDITION. BE IT ORDAINED by the Council of the Village of r North Olmsted, State of Ohio: Section 10 No person, firm or corporation shall make any opening or remove any pavement in any streets, boulevards, avenues or public places in the Village of North Olmsted until such person shall file with the Mayor of the Village a written or printed application setting forth and indicating thereon the location, kind and extent of the pave - ment desired to be taken up, the number, purpose and size of r openings or excavations which are desired or necessary. The applicant shall pay to the Village of North..Olmsted $3,00 for the General Fund before the permit is issued and shall deposit with the Village an additional amount sufficient to cover the cost of repairing and relaying the said pavement to be removed, together with the cost of any new material required, plus fifteen per cent (15 %) for the cost of inspection and general supervision, as the same'shall be estimated by the Mayor. Section 2. After the deposit herein required has been made, the Mayor shall issue the permit applied for. Said permit shall state the exact time when the opening or excavation is to be made, the probable length of time required for doing the work and the making of the repair, the character of the pavement, including its base, and the character of the ti work necessary for the satisfactory relaying of the pavement. It shall be the duty of the Village itself to relay the pave- ment, either temporarily or permanently, as may be determined ,t by the Mayor. Section 3. When such work is completed and the pavement relaid, the Mayor will determine the cost of the work of relaying the pavement, together with the cost of new materials required and the cost of inspection and supervision, as the case may be, which amount shall be deducted from the deposit made by the applicant and the Clerk shall issue a check to the applicant for the return of the excess over and above the amount necessary to reimburse the Village for the expense of relaying the pavement, together with the cost of new material and supervision. Section 4. -.If the deposit be insufficient to re- imburse the Village, the Mayor shall collect from the applicant a sufficient amount to reimburse the Village for the expense incurred. Section 5. If the application is for a permit to open the street in what.is known as the "tree lawn, 11 then the applicant shall make the 3.00 payment for a permit and shall deposit with the Clerk 815,00 . per square. yard based on the size of the opening, as a guarantee that he will restore the street to its original condition or pay the Village for restoring the same., which deposit, less the cost of inspection, shall be returned to the person, firm or corporation who made the same when a certificate is issued by the Village Engineer that the street has been restored to the same condition as before the opening was made. Section 6. Any person, firm or corporation who shall make any openings or remove the pavement in any street, boulevard, avenue or public ground of the Village of North F f i
