,.1 <br />Y, <br />Ordinance No. <br />By mr. . <br />AN ORDINANCE <br />PROHIBITING DOGS RUNNING AT LARGE AND REGULATING THE KEEPING <br />OF DOGS.: <br />BE IT ORDAINED by the Council of the Village of North <br />Olmsted, State of Ohio: <br />Section 1. (a) No person, being the owner or in <br />charge or control of any dog, shall permit said dog to run at <br />large within the limits of this Village except as provided in <br />subsection (c) hereof. Unauthorized entry by said dog upon <br />any premises or upon any public street or ground shall consti- <br />tute running at large within the meaning of this subsection. <br />(b) No person, b eing the owner, or in charge or <br />control of any dog, shall permit such dog to go or remain upon <br />any public street or ground within the limits of this. Village <br />except when accompanied by a responsible person and upon a <br />leash or under such control as to prevent such dog from enter.. <br />ing priv`a.te property and from chasing or attacking any person, <br />animal or vehicle. <br />(c) The provisions of-subsections (a) and (b) .hereof <br />shall not prevent a person from running a dog, during the <br />season when such running is lawful, upon vacant property and <br />Public streets and grounds adjacent thereto, not less than 500 <br />feet from any lot or parcel improved with a dwelling. <br />(d)' Every owner and person in charge or control of a <br />female dog shall, during all times when such female dog is in' <br />heat, either remove and keep her out of this Village or confine <br />or treat her in such 'manner as not to attract other dogs. <br />(e) No person shall keep or harbor within this Village <br />any dog which by barking, biting, howling or in any way.or <br />manner injures or disturbs the quiet of any other person, or <br />Which 'destroys or damages .any other personts lawn, tree, shrub, <br />Plant, building. or other property. <br />(f) In addition to other penalties applicable to <br />Violations of this section , it shall be the duty of the police . <br />department of this Village to take up and impound every dog <br />found in violation of this section. If such dog is not wear - <br />ing a valid license tag, the police department shall turn it <br />over forthwith--to an officer charged by law with the custody <br />and disposal of such dogs. If such dog is wearing such a tag,.. :. <br />h e cpolice department shall immediately give the licensee, if <br />an be found, 'written notice that the dog' has been taken <br />uP. The dog shall not-be released except on payment of the <br />reasonable expense of taking it up.and keeping it as determined <br />by the person in charge of -the police department, but not less <br />than $2.00, and any dog not reclaimed within 7 days of receipt, <br />notice by the licensee, or within 10 days of taking it up if <br />the licensee cannot be. found, shall be destroyed or otherwise, <br />disposed of at the discretion of the person in charge of the <br />Aolice,department <br />
