Ordinance No.(�� <br />By Ur <br />AN ORDINANCE <br />DETERMINING TO PROCEED WITH THE IMPROVEMENT OF LUCYDALE AVENUE, <br />FROM LORAIN ROAD TO THE SOUTH LINE OF SUBLOT 39,' BY GRADING, <br />DRAINING AND SLAGGING SAME. <br />BE IT ORDAINED by the'Council of the Village of <br />North Olmsted, State of Ohio; <br />Section 1. That it is hereby determined,to pro- <br />ceed with the improvement of Lucydale Avenue, from Lorain Road <br />to the South line of Sublot 39, by grading, draining and slagging <br />same, in accordance with Resolution No. 1535 passed on the 21st <br />day of September, 1948, and in.accordance with the plans, <br />specifications, estimates and profiles heretofore approved and <br />now on file in the office of the Clerk. <br />Section 2. That all claims for damages result- <br />ing therefrom shall be judicially inquired into after the <br />completion of the proposed improvement, and the solicitor be, <br />and he is hereby, authorized and directed to institute proceed - <br />ings in a court of competent jurisdiction to inquire into such <br />claims. <br />Section 3. 'That the cost of said improvement <br />shall be assessed by the foot front upon the following de- <br />scribed lots and lands, to wit, all 'lots and lands bounding <br />and abutting upon the proposed improvement, which said lots <br />and lands are hereby determined to be specially benefited by <br />said improvement; and the cost of said improvement shall in- <br />clude the expense of preliminary and other surveys, of printing <br />and publishing the notices, resolutions and ordinances required, <br />the serving f said notices the cost of construction, together <br />with interest on notes or bonds issued in anticipation of <br />collection of deferred assessments and all other necessary <br />expenditures. <br />Section 4. That the assessments so, to be levied <br />shall be paid in five annual installments, with interest not <br />to exceed six p er cent per annum on deferred payments, provided <br />that the owner of any property assessed may, at his option, <br />Pay such assessment in cash within thirty days from and after <br />the passage of the assessing ordinance, in which case said <br />assessment shall not include any item of interest upon notes <br />or bonds to be issued in anticipation of the collection of <br />deferred installments of assessments. <br />Section 5. That notes or bonds of the Village of <br />North Olmsted shall be issued in anticipation of the collection <br />Of assessments by installments and in an amount equal thereto. <br />Section 6. That the remainder of .the entire cost <br />of said improvement not specially assessed, including the cost <br />Of intersections, shall be paid out of the General Fund or by <br />the issuance of bonds of the Village of North Olmsted for that <br />Purpose, in the manner provided by law. <br />Section 7. That the Clerk be, and he is hereby, <br />authorized and directed to advertise for bids for the construc- <br />tion of said improvement according to law. <br />Section 8. This ordinance °is hereby declared <br />to be an emergency measure, the emgrgency being that it is <br />necessary for the immediate preservation of public health, <br />Peace, safety and welfare that this ordinance be passed at <br />once and shall take effect and be in force from and after its <br />Passage, <br />Passed: February 1, 1949. <br />t <br />ler �� Mayor <br />
