Ordinance N 0 �3 <br />By Mr. <br />AN ORDINANCE <br />DETERMINING TO PROCEED WITH THE IMPROVEMENT OF MCKEN'ZIE ROAD, <br />FROM MARUSCHAK PROPERTY TO NORTHERLY LINE OF GRACE MASON'S <br />PROPERTY, BY CONSTRUCTING THEREIN A VDATER MAIN. <br />BE IT ORDAINED by the Council of the Village of <br />North Olmsted, ` State of Ohio: <br />Section 1. That it is hereby determined to proceed <br />with the improvement of McKenzie Road, from Maruschak property <br />to northerly 'line of Grace Mason's property, by constructing <br />therein a water main, in' accordance with Resolution No. 1645 <br />passed on the 6th day of June, 1950, and the petition of property <br />owners described`in said resolution, and in accordance with the <br />plans, specifications, estimates and profiles heretofore approved <br />and now on file in the office of the Clerk. <br />Section 2. That all claims for damages resulting there- <br />from shall be judicially inquired into after the completion of <br />the proposed improvement, and the solicitor be, and he is here - <br />by authorized and directed to institute proceedings in a court <br />of competent jurisdiction .to inquire into such claims. <br />Section 3. That the cost of said improvement shall be <br />assessed by the foot front upon the following described lots <br />and lands, to wit, all lots and lands bounding and abutting <br />upon the proposed improvement, which said lots and lands are <br />hereby determined to be specially benefited by said improvement; <br />and the cost of said improvement shall include the expense of <br />preliminary ' and other surveys, of printing and publishing the. <br />notices, resolutions and ordinances' required, the serving of <br />said notices, the cost of construction, together with interest <br />on notes or bonds .issued in anticipation of collection of de-. <br />ferred assessments and all other necessary expenditures <br />Section 4. That` the assessments so to be levied shall <br />be paid in ten annual installments, with interest not to, exceed <br />six per cent per 'annum on deferred' payments, provided that the <br />owner of any property assessed may, at his option, pay such <br />assessment in cash within thirty days' from and after the passage <br />of the assessing ordinance, in which case said assessment shall <br />not include' any item of interest upon notes or bonds to be issued <br />in anticipation of the collection of. deferred installments of <br />assessments. <br />Section 5. That notes or bonds'of the,Village of North <br />Olmsted shall be issued in anticipation of the collection of <br />assessments by installments and in an amount equal' thereto. <br />Section 6. That the Village Engineer be and he is <br />hereby directed to prepare and file with this council a tentative <br />assessment showing the amount to be assessed on each lot or <br />parcel of land to be assessed. <br />Section 7. That the Clerk be, and he is hereby, <br />authorized and directed' to advertise for bids for the construc- <br />tion of said improvement according to law. <br />Section S. This ordinance -is hereby declared to b e <br />an emergency measure, the emergency being that it is necessary <br />for the immediate preservation of public health, peace, safety <br />and welfare that this ordinance be passed at once and shall take <br />effect and be in force from and after its passage. <br />Passed: August 15, 1950. <br />
