I Ordinance No. -_� By Mr. AN ORDnT AN CE DETERMINING TO PROCEED WITH THE IMPROVEMENT OF PORTER ROAD, FROM LORAIa . ROAD TO THE NORTH LINE OF THE S. S. SCHEMER PROPERTY, BY CCK STRUCTIN G THEREIN A WATER MAIN. BE IT ORDAINED by the Council of the Village of North Olmsted, State of Ohio: Section 1. That it is hereby determined to proceed .with the improvement of Porter Road, from Lorain Road to the North line of the S. S. Scherrer property, by constructing therein a water main, in accordance with Resolution No. 1611 passed on the 7th day of March, 1950, and the petition of property owners described in said resolution, and in accordance with the plans, specifications, estimates and profiles heretofore approved and now on file in the office of the Clerk. Section 2. 'That all claims for damages resulting therefrom shall be judicially inquired into after the completion Of the proposed improvement, and the solicitor be, and he is hereby authorized and directed to institute proceedings in a court of competent jurisdiction to inquire into such claims. Section 3. That the cost of said improvement shall be assessed by the foot front upon the following described lots and lands, to wit, all lots and lands bounding and abutting upon the proposed improvement, which said lots and lands are , hereby determined to be specially benefited by said improvement; and the cost of said improvement shall include the expense of preliminary and other surveys, of printing and publishing the notices.. resolutions and vrd:nances required, the serving of said notices, the cost of construction, together, with interest on notes or bonds issued in anticipation of collection of deferred assessments and all other necessary expenditures. Section 4. That the assessments so to be levied shall be paid in ten annual installments, with interest not to exceed six per cent per annum on deferred payments, provided that the owner of any property assessed may, at his option, pay such assess- went in cash within thirty days from and after the passage of the assessing ordinance., in which,case said assessment shall not include any item of interest upon notes or bonds to be issued In anticipation of the collection of deferred installments of assessments. Section 5. That notes or bonds " of the Village of North Olmsted shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto. Section 6. That the Village Engineer be and he is hereby directed to prepare and file with this council a tentative. assessment showing the amount to be assessed on each lot or parcel Of land to be assessed, Section 7. That the Clerk be, and he is hereby, author - ized and directed to advertise for bids for the construction of said improvement according to law. Section 8. This ordinance is hereby declared to be an emergency measure, the emergency; being that it is necessary for the immediate preservation of public health, peace, safety and welfare-'that this ordinance be passed at once and shall take effect and be in force from and after its passage.
