I <br />Ordinance No. -_� <br />By Mr. <br />AN ORDnT AN CE <br />DETERMINING TO PROCEED WITH THE IMPROVEMENT OF PORTER ROAD, FROM <br />LORAIa . ROAD TO THE NORTH LINE OF THE S. S. SCHEMER PROPERTY, BY <br />CCK STRUCTIN G THEREIN A WATER MAIN. <br />BE IT ORDAINED by the Council of the Village of North <br />Olmsted, State of Ohio: <br />Section 1. That it is hereby determined to proceed <br />.with the improvement of Porter Road, from Lorain Road to the North <br />line of the S. S. Scherrer property, by constructing therein a <br />water main, in accordance with Resolution No. 1611 passed on the 7th <br />day of March, 1950, and the petition of property owners described <br />in said resolution, and in accordance with the plans, specifications, <br />estimates and profiles heretofore approved and now on file in the <br />office of the Clerk. <br />Section 2. 'That all claims for damages resulting <br />therefrom shall be judicially inquired into after the completion <br />Of the proposed improvement, and the solicitor be, and he is <br />hereby authorized and directed to institute proceedings in a <br />court of competent jurisdiction to inquire into such claims. <br />Section 3. That the cost of said improvement shall <br />be assessed by the foot front upon the following described lots <br />and lands, to wit, all lots and lands bounding and abutting upon <br />the proposed improvement, which said lots and lands are , hereby <br />determined to be specially benefited by said improvement; and the <br />cost of said improvement shall include the expense of preliminary <br />and other surveys, of printing and publishing the notices.. <br />resolutions and vrd:nances required, the serving of said notices, <br />the cost of construction, together, with interest on notes or <br />bonds issued in anticipation of collection of deferred assessments <br />and all other necessary expenditures. <br />Section 4. That the assessments so to be levied shall <br />be paid in ten annual installments, with interest not to exceed <br />six per cent per annum on deferred payments, provided that the <br />owner of any property assessed may, at his option, pay such assess- <br />went in cash within thirty days from and after the passage of the <br />assessing ordinance., in which,case said assessment shall not include <br />any item of interest upon notes or bonds to be issued In anticipation <br />of the collection of deferred installments of assessments. <br />Section 5. That notes or bonds " of the Village of <br />North Olmsted shall be issued in anticipation of the collection of <br />assessments by installments and in an amount equal thereto. <br />Section 6. That the Village Engineer be and he is <br />hereby directed to prepare and file with this council a tentative. <br />assessment showing the amount to be assessed on each lot or parcel <br />Of land to be assessed, <br />Section 7. That the Clerk be, and he is hereby, author - <br />ized and directed to advertise for bids for the construction of said <br />improvement according to law. <br />Section 8. This ordinance is hereby declared to be an <br />emergency measure, the emergency; being that it is necessary for <br />the immediate preservation of public health, peace, safety and <br />welfare-'that this ordinance be passed at once and shall take effect <br />and be in force from and after its passage. <br />Passed: June 6, 1950. <br />x; <br />e r1c <br />Mayor' <br />a - <br />4 <br />
