Ordinance No._ /�? <br />By <br />AN ORDINANCE <br />DETERMINING TO PROCEED WITH THE IMPROVEMENT OF SILVERDALE ROAD, <br />FROM THE NORTH LINE OF, SUBLOT 29 TO THE END OF. THE STREET, . BY <br />CONSTRUCTING THEREIN A WATER MAIN <br />i. <br />BE IT ORDAINED by the Council of the Village of North <br />Olmsted, State of Ohio: <br />Section 1, That it is hereby determined to proceed <br />with the improvement of Silverdale Road, from'the north line of <br />Sublot 29 to the end of the street, by constructiong therein <br />a water main,in accordance with.Resolution No. 1610 passed on the <br />21st day of February, 1950, and the petition of property owners <br />described in said resolution, and in accordance with the plans, <br />specifications, estimates and profiles heretofore approved and <br />now on file in the office of the Clerk. <br />Section 2: That all claims for damages resulting <br />therefrom shall be judicially inquired into after the completion <br />of the proposed improvement, and the solicitor be, and he is <br />hereby authorized and directed to institute proceedings in a <br />court of competent jurisdiction to inquire into such claims. <br />Section 3. That the cost of said improvement shall <br />-be assessed by the foot front upon the following described lots <br />and lands, to wit, all lots and lands bounding and abutting upon <br />.the proposed improvement; which said lots and lands are hereby <br />determined to be specially benefited by said 'improvement; and the <br />cost of said improvement shall include the expense of preliminary <br />and other surveys, of printing and publishing the notices, <br />resolutions and ordinances required, the serving of said notices, <br />the cost of construction, together with interest on notes or <br />bonds issued in anticipation of_ collection of deferred assessments <br />and all other necessary expenditures. <br />Section 4. That the.assessments so to be levied shall <br />be-paid in ten annual installments, with interest not to exceed <br />six per cent per annum on deferred-payments, provided that the <br />owner of any property assessed may, at his option, pay such <br />assessment in cash within thirty days from and after the passage <br />of the assessing ordinance, in Which case said assessment shall <br />not include any item of interest upon, notes or bonds to be issued <br />in anticipation of the collection of. deferred installments of <br />assessments. <br />Section 50 That notes or bonds of the Village of <br />North Olmsted shall be issued in anticipation of the collection <br />of assessments by installments and in an amount equal thereto. <br />Section 6. That the Village Engineer be and he is <br />hereby directed to prepare and file with this council a tentative <br />assessment showing the amount to be assessed on each lot or <br />parcel of land to be assessed. <br />Section 7. That the Clerk be, and he is hereby, <br />authorized and directed to advertise for bids for the _construction <br />of said improvement according to law. - <br />Section 8. This ordinance is hereby declared to be an <br />emergency measure, the emergency being that it is necessary for <br />the immediate preservation of public health, peace, safety and <br />welfare that this ordinance be passed at once and shall take effect <br />and be in force from and after its passage. <br />Passed: May 16, 1950. <br />C- -e Mayor <br />5` <br />� c <br />
