Ordinance No. EC' <br />By Mr._ <br />AN ORDIN AN CE <br />DETERMINING TO PROCEED WITH THE IMPROVEPIi NT OF SELHURST ROAD, <br />ITS ENTIRE LENGTH, BY . C (K STRUCTIN G THEREIN A WATER MAIN. <br />BE IT ORDAINED by the council of the Village of North <br />Olmsted, BE <br />of Ohio: <br />Section.l. That it is hereby determined to proceed <br />With the improvement of Selhurst,Road,_its entire length, by con - <br />structing therein a water main, in accordance with Resolution <br />No. 1601 passed on the 10th day of January, 1950, and the petition <br />of it operty owners described in said resolution, and in accordance- <br />with the plans, specifications, estimates and profiles heretofore <br />approved and now on file in the office of the Clerk. <br />Section 2.. That all claims for damages resulting <br />therefrom shall be judicially inquired into after -the completion <br />Of the proposed improvement, and the solicitor be, and he is hereby, <br />authorized and directed to institute proceedings in a court of <br />competent jurisdiction to inquire into such claims. <br />Section 3. That the cost of said improvement shall be <br />assessed by the foot front upon the following described lots and <br />lands, to wit, all lots and lands bounding and abutting upon the <br />Proposed improvement,. which said lots and lands are hereby de- <br />termined to be specially benefited by said improvement; and the <br />cost of said improvement shall include the expense of preliminary <br />and other surveys, -of printing and publishing the notices, <br />resolutions and ordinances required, the serving of said notices, <br />the'cost of construction, together with interest on notes or bonds <br />issued in anticipation of collection of deferred assessments and <br />a11 other necessary expenditures. <br />Section 4. That the assessments so to be levied shall <br />be paid in ten annual installments, with interest not to exceed <br />six per cent per annum on deferred-payments., provided that the <br />owner of any property assessed may, at his option, pay such <br />assessment in cash within thirty days from and after the passage <br />Of the assessing ordinance, in which case said assessment shall <br />not include any item of interest upon notes or bonds to be issued <br />in anticipation of the collection of deferred installments of <br />assessments. <br />Section 5: That notes or bonds of the Village of <br />North Olmsted shall be issued in anticipation of the collection <br />Of assessments-by installments and in an amount equal thereto. <br />Section 6. That the Village Engineer be and he is <br />hereby directed to prepare and file with this council a tenWLtive <br />assessment showing the amount to be assessed on each lot or <br />Parcel of land to be assessed. <br />Section 70 That the Clark be, and he is hereby, <br />authorized and directed to advertise forbids for the construction <br />of said improvement according to law. <br />Section 8. This ordinance is hereby declared to-be an <br />emergency measure, the emergency being that it is necessary for <br />the immediate preservation of-public health, peace, safety and <br />welfare that this ordinance be passed at once and shall take effect <br />and be in force from and after its passage, <br />Passed: May 16, 19500 <br />er <br />l� + <br />i <br />sly <br />
