Ordinance No. EC' By Mr._ AN ORDIN AN CE DETERMINING TO PROCEED WITH THE IMPROVEPIi NT OF SELHURST ROAD, ITS ENTIRE LENGTH, BY . C (K STRUCTIN G THEREIN A WATER MAIN. BE IT ORDAINED by the council of the Village of North Olmsted, BE of Ohio: Section.l. That it is hereby determined to proceed With the improvement of Selhurst,Road,_its entire length, by con - structing therein a water main, in accordance with Resolution No. 1601 passed on the 10th day of January, 1950, and the petition of it operty owners described in said resolution, and in accordance- with the plans, specifications, estimates and profiles heretofore approved and now on file in the office of the Clerk. Section 2.. That all claims for damages resulting therefrom shall be judicially inquired into after -the completion Of the proposed improvement, and the solicitor be, and he is hereby, authorized and directed to institute proceedings in a court of competent jurisdiction to inquire into such claims. Section 3. That the cost of said improvement shall be assessed by the foot front upon the following described lots and lands, to wit, all lots and lands bounding and abutting upon the Proposed improvement,. which said lots and lands are hereby de- termined to be specially benefited by said improvement; and the cost of said improvement shall include the expense of preliminary and other surveys, -of printing and publishing the notices, resolutions and ordinances required, the serving of said notices, the'cost of construction, together with interest on notes or bonds issued in anticipation of collection of deferred assessments and a11 other necessary expenditures. Section 4. That the assessments so to be levied shall be paid in ten annual installments, with interest not to exceed six per cent per annum on deferred-payments., provided that the owner of any property assessed may, at his option, pay such assessment in cash within thirty days from and after the passage Of the assessing ordinance, in which case said assessment shall not include any item of interest upon notes or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section 5: That notes or bonds of the Village of North Olmsted shall be issued in anticipation of the collection Of assessments-by installments and in an amount equal thereto. Section 6. That the Village Engineer be and he is hereby directed to prepare and file with this council a tenWLtive assessment showing the amount to be assessed on each lot or Parcel of land to be assessed. Section 70 That the Clark be, and he is hereby, authorized and directed to advertise forbids for the construction of said improvement according to law. Section 8. This ordinance is hereby declared to-be an emergency measure, the emergency being that it is necessary for the immediate preservation of-public health, peace, safety and welfare that this ordinance be passed at once and shall take effect and be in force from and after its passage, Passed: May 16, 19500 er l� + i sly
