.Resolution No. 1523 <br />By Mr. Baumgardner <br />A RESOLUTION <br />DECLARING IT NECESSARY TO IMIIOVE MARION ROAD, FROM CLAGUE <br />ROAD TO WEST 230th STREET, AND WEST 230th STREET, FROM THE <br />NORTH VILLAGE LINE TO CLIFFORD DRIVE, BY SURFACING SAME WITH <br />BITUMINOUS MACADAM. <br />WHEREAS the owners of a majority of the foot frontage <br />of property on Marion Road, from Clague Road to West 230th <br />Street, and West 230th Street, from the North Village line to <br />Clifford Drive, have petitioned in writing for the improvement <br />of said streets by ,.surfacing same with bituminous macadam, and <br />WHEREAS Marion Avenue and West 230th Street are <br />streets physically connected, and <br />WHEREAS it will be more advantageous and economical <br />to improve said streets as one project; now, therefore, <br />BE IT RESOLVED by the Council of the Village of <br />North Olmsted, Ohio, three- fourths of all members elected thereto <br />concurring: • <br />Section 1. That it <br />Road, from Clague -Road to West <br />Street, from the North Village <br />surfacing same with bituminous <br />plans and specifications prepa <br />is necessary to improve Marion <br />230th Street, and West 230th <br />Line to Clifford Drive, by <br />macadam in accordance with the <br />red by the Village Engineer. <br />Section 2. That the grade of said streets shall be <br />the grade shown on the plans and specifications for said <br />improvements, which said grade and elevations are hereby con - <br />firmed and established as 'the grade of said streets. <br />Section 3. That the plans, specifications, estimates <br />and profiles of the proposed improvements heretofore prepared <br />by the Village Engineer and now filed in the office of the <br />Village Clerk be, and the same are hereby, approved. <br />Section 4. That the cost of said improvements shall <br />be assessed by the foot front upon the following described <br />lots and lands, to wit, all lots•and lands bounding and abutting <br />upon the proposed improvement, which said lots and lands. are <br />hereby determined to be specially benefited by.said improvement;` <br />and the cost of said improvement shall include the expense of <br />preliminary and other surveys, of printing and publishing the <br />notices, resolutions and ordinances required, the serving of <br />said notices, the cost of construction,,-together with interest <br />on notes or bonds issued in anticipation of collection of de- <br />ferred assessments and all other necessary expenditures. <br />Section 5. That the assessments so to be levied <br />shall be paid in five anna.al installments, with interest not <br />to exceed six per cent per annum on deferred payments, provided <br />that the owner of sany property assessed may, at his option, <br />p'ay such assessment in cash within thirty days from and after <br />the passage of the assessing ordinance, in which case said <br />assessment shall not include any item of interest upon notes <br />or bonds to be issued in anticipation of the collection of de- <br />ferred installments of assessments. <br />Section 6. That noteh or bonds of the Village of <br />North Olmsted shall be issued in anticipation of the collec- <br />tion of assessments by installments and in an amount equal <br />thereto. <br />Section 7. That the remainder'of the entire cost <br />of said improvement not specially assessed, including the <br />cost of intersections, shall be paid out of the General Fund <br />or by the issuance of bonds of the Village of North Olmsted <br />for that purpose, in the manner provided by law. <br />Section 8. . This resolution shall take effect and <br />be in force from and after the earliest period allowed by <br />
