Resolution No. 1575 By Mr. Crider A RESOLUTION DECLARING IT NECESSARY TO IMPROVE ANDRUS AVENUE, FROM THE BOULEVARD (NORTHERLY END OF ANDRUS AVENUE) TO KENNEDY RIDGE ROAD, BY GRADING, DRAINING AND SLAGGING SAME. WHEREAS the owners of a majority of the foot frontage of property on Andrus Avenue, from the Boulevard (northerly end of Andrus) to Kennedy Ridge Road, have petitioned in writing for the improvement. of said street' between the points aforesaid, by grading, draining and slagging same; now, therefore, BE IT RESOLVED by the Council of the Village of North Olmsted, State of Ohio, three - fourths of all members elected thereto concurring; Section 1. That it is necessary to improve Andrus Avenue, from the Boulevard to Kennedy Ridge Road, by grading, draining and slagging same, in accordance with the plans and specifications prepared by the Village Engineer. Section 2. That the grade of said street shall be the grade shown on the plans and specifications for said improvement, which said grade and elevations are hereby confirmed and established as the grade of said street. Section 3. That_ the plans, specifications, estimates and profiles of the proposed improvement heretofore prepared by the Village Engineer and now filed in the office of the Village Clerk be' and the same are hereby approved. Section 4. That the cost of said improvement, less 1/50 thereof and the cost of intersections, shall be assessed by the foot front upon the following described lots. and lands, to wit, all lots and.lands bounding and abutting upon the proposed improve- ment, which said lots and lands are hereby determined to be specially_ benefited by said improvement; end the cost of-said improvement shall include the expense of preliminary and other surveys, of printing and publishing the notices, resolutions and ordinances re- quired,, the serving of said notices, the cost of construction, to- gether with interest on notes or bonds issued in anticipation of. collection of deferred assessments and all other necessary expenditures. Section 5. That the assessments so to be levied shall be paid in five annual installments, with interest not to exceed six per cent per annum on deferred- payments, provided that the owner of any property assessed may, at his option, pay such assess- ment in cash within thirty days from and after the passage of the . , assessing ordinance, inwhich case said assessment shall not include any item of interest upon notes or bonds to be issued in anticipa- tion of the collection of deferred installments of assessments. Section 6. That notes or bonds of the Village of North Olmsted shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto. Section 7. That the remainder of the entire cost of said improvement not specially assessed, including the cost of intersections, shall be paid out of the General Fund or by the issuance of bonds of the Village of North Olmsted for that purpose in the manner provided by law. Section 8. This resolution I hereby declared to be an emergency measure, the emergency being that it is necessary for the immediate preservation of public health, peace, safety and welfare that this resolution be passed at once and shall take effect and be in force from and after its passage.
