Resolution No. 1575 <br />By Mr. Crider <br />A RESOLUTION <br />DECLARING IT NECESSARY TO IMPROVE ANDRUS AVENUE, FROM THE BOULEVARD <br />(NORTHERLY END OF ANDRUS AVENUE) TO KENNEDY RIDGE ROAD, BY GRADING, <br />DRAINING AND SLAGGING SAME. <br />WHEREAS the owners of a majority of the foot frontage <br />of property on Andrus Avenue, from the Boulevard (northerly end of <br />Andrus) to Kennedy Ridge Road, have petitioned in writing for the <br />improvement. of said street' between the points aforesaid, by grading, <br />draining and slagging same; now, therefore, <br />BE IT RESOLVED by the Council of the Village of North <br />Olmsted, State of Ohio, three - fourths of all members elected thereto <br />concurring; <br />Section 1. That it is necessary to improve Andrus <br />Avenue, from the Boulevard to Kennedy Ridge Road, by grading, draining <br />and slagging same, in accordance with the plans and specifications <br />prepared by the Village Engineer. <br />Section 2. That the grade of said street shall be the <br />grade shown on the plans and specifications for said improvement, <br />which said grade and elevations are hereby confirmed and established <br />as the grade of said street. <br />Section 3. That_ the plans, specifications, estimates <br />and profiles of the proposed improvement heretofore prepared by the <br />Village Engineer and now filed in the office of the Village Clerk <br />be' and the same are hereby approved. <br />Section 4. That the cost of said improvement, less <br />1/50 thereof and the cost of intersections, shall be assessed by <br />the foot front upon the following described lots. and lands, to wit, <br />all lots and.lands bounding and abutting upon the proposed improve- <br />ment, which said lots and lands are hereby determined to be specially_ <br />benefited by said improvement; end the cost of-said improvement <br />shall include the expense of preliminary and other surveys, of <br />printing and publishing the notices, resolutions and ordinances re- <br />quired,, the serving of said notices, the cost of construction, to- <br />gether with interest on notes or bonds issued in anticipation of. <br />collection of deferred assessments and all other necessary expenditures. <br />Section 5. That the assessments so to be levied shall <br />be paid in five annual installments, with interest not to exceed <br />six per cent per annum on deferred- payments, provided that the <br />owner of any property assessed may, at his option, pay such assess- <br />ment in cash within thirty days from and after the passage of the <br />. , assessing ordinance, inwhich case said assessment shall not include <br />any item of interest upon notes or bonds to be issued in anticipa- <br />tion of the collection of deferred installments of assessments. <br />Section 6. That notes or bonds of the Village of North <br />Olmsted shall be issued in anticipation of the collection of <br />assessments by installments and in an amount equal thereto. <br />Section 7. That the remainder of the entire cost of <br />said improvement not specially assessed, including the cost of <br />intersections, shall be paid out of the General Fund or by the <br />issuance of bonds of the Village of North Olmsted for that purpose <br />in the manner provided by law. <br />Section 8. This resolution I hereby declared to be <br />an emergency measure, the emergency being that it is necessary for <br />the immediate preservation of public health, peace, safety and <br />welfare that this resolution be passed at once and shall take effect <br />and be in force from and after its passage. <br />Passed; September 6, 1949. <br />Mayor <br />
