<br />NOVEMIDEft l, 1955 M.INUTES OF A IMTING OF THE COUNCIL OF THE CITY OF <br />NORTH OIMSTED, OHIO <br />Present were Dr. C. B. Lewis, Mayor, E. W. Baumgardner, President of Council, <br />L. H. Baker, Harry M. Crider, R. L. Decker, R. G. Rnapp, William H. Kramer, <br />R. G. Neubzuer, G. H. Schwenk. <br />A motion was made by Mr. Kramerand secon@ed by Mr. Schwenk that the minutes of <br />October 18, 1955 be approved as read. - <br />Ordinanca #2205 was given ita third reading. <br />A Public Hearing was held on Ordinance #22050 <br />Thirty-four residents voiced their opinions to the rezoning of the property <br />west of West Park Drive for the erection of a shopping center, which are attached <br />and made a part : of these minutes. <br />The Clerk read c anmunications from Mrs. J. C. Lovell and Mr. R. 0. Gilchrist.. <br />The Clerk read the f ollowing c ammunications f rcx Saul. S. Biskind: <br />01) "In connection with the erection of the shoppixig center at the n. w. <br />_corner of Lorain Roa,d and West Park Drive in your city and as a contribution <br />towards the safety of the users of North Olmsted Community Park, the under- <br />signed, The West Cuqahoga Land Co., the developers of the proposed shopping <br />csnter, agrees to contribute towards the erection of a barri.er fence along the <br />west sidQ of.tha Comununity Park, From Lorain Road north agproximately 1800 <br />_ feet to about where the wooded section of;the park begins. <br />"Further, said ceampany agrees to make available to the public at no charge, <br />the entire pa.rking axea of-its shoppirig center at ang and all times.. <br />. (Signed) The West Cuyaho;a Land Co, <br />Saul S. Biskind, Pres." <br />(#2) "This is to adv3.se you that we have in our possession a warranty deed, exa- <br />cuted by Lloyd R. Leick which contains the follm3.ng restrictions: <br />"As part af.the consideration hereof, the Grantee covenants and agrees to <br />and with the Grantor that the follawing restriction shall be binding upan <br />the Grantee herein named, its successors and assigns, until-Nrnrember `,1976 <br />to-wit: No driveway sha11 be constructed a].ong the frontage of West Park Drive <br />in connection with any cammercial building unless such driveway provided con- <br />tinuous access t o the parking area serving t he shopping eenter to be situated <br />on the premises herein conveyed. No cemmercial buil.ding or structure shall be <br />erected nearer to the westerly side line of.West Park Drive than 100 feet." <br />' . To pay in full the cost of erecting a barrier fence along the west side of <br />the Commmity Park, from Lorain Road north approxd.mately 1800 feet to about <br />where the wooded section of the parY begins.: - <br />2o To pay ons halY the cost of installing public sidewalk along the above re- <br />ferred to barrier fence. <br />3. To make available to the public at no charge the entire parking area of the <br />shopping center at any and all t3mes. <br />'4. To abide by all municipal regulations concerning lighting, noises.and ad- -7C <br />.• vertiEing as affecting the shopping center. <br />5. To install arui pay the entire cost of and to always maintain at ita cost, a <br />sewage disposal plant to handle all.the sewage of stnicturas'on this proper- <br />ty. _ <br />6.
