<br />Lorain Road, Attorney Milton H. tdyner presented a petition signed by fourteen '
<br />residents objecting to the rezoning of the Ackerer praperty from a multiple
<br />resi.dence district to a retail business district. He stated people bui.lt homes
<br />in that area, r elying on the fact that it was zoned and protected as multiple
<br />. residence area. IY xezoned, they would suffer a loss of property and a loss of ?
<br />,property rights. He'said rezoning wauld be to the personal advantage of Mr. ;
<br />Ackerer, but it would be to a great disadvantage to a]1 the other residents in '
<br />that area. He further stated to do this would be spot zonina, which is contrary
<br />to the law of the State of Ohio He s? ?
<br />. a3.d if the council should see fit :to pass ,
<br />the ordinance, t hen the only recourse would be to the courts, and they did not;
<br />want to go to court unless necessary. ;
<br />A. cammunication was read from 14rs. tiiilliam Rees, requesting that her name be stricken
<br />frwn the above petition. ?
<br />? Mr. Laurence Maroon, owner of parcel directly across fran the.Ackerer property, said ?
<br />they had no objection to the Ackerer property being rezoned for business.

<br />Ordinance #2120 was given its third reading. A motion was m2.de by Mr. Schwenk and ?
<br />seconded by Mr. Baker that the above Ordinance be adopted. "Yeas" Decker, Knapp, ?
<br />Schwenk. "Nays" Baker, Crider, Kramer. There being a tie vote, the President of ?
<br />Council voted "yea,n ?
<br />The Mayor stated it was learned that the Flehearty water main only extended to the ?
<br />, center of the new Brookpark Road. He said rather than let them lay concrete over
<br />it, which would make it expensive to extend the water line later on, the Board of
<br />Control felt it best to extend it across Brookpark Road at this time. The S& W
<br />Construction Company would do this work at $10.00 per lineal foot.
<br />Resolution #2133 was introduced by Mr. Decker. A Resolution autharizing and direct- k!
<br />ing the Director of Public Service -to enter 3nto a contract for the construction of G
<br />a water main under Brookpark Hoad and Flehearty Road. It was moved and seconded

<br />The Mayor read a comununication `from Walter and Haverfield regarding l:ouse Joint
<br />Resolution No. 5 introduced by Mr. Wheel.?er, in the lOlst General Assembly of Ohio, ?
<br />proposing to provide for the legislative sub-districting of Cuyahoga County for ;
<br />election of State Senators and State Representatives. - ?
<br />Resolution`#2134 was introduced by Mr. Kramer.' A:Resolution recommending the adop- ?
<br />tion of Wheeler Joint Resolutian proposing constitutional amendment t o provide for ?
<br />dividing Cuyahoga County into sub-divisions for election of Senators and Representa- ?
<br />tives.' It was moved and seconded that the above Resolution be adopted as read.
