Council Minutes of 02-18-2014 <br /> Kearney, Schumann and Williamson; Planning/Development Director Wenger; <br /> Safety/Service Director Glauner and guests. <br /> • Discussed was Resolution 2014-14 which is a Resolution authorizing the Mayor <br /> to enter into a Memorandum of Understanding ("MOU") Agreement with the <br /> Cuyahoga County Soil and Water Conservation District ("SWCD") to provide the <br /> City of North Olmsted with Minimum Control Measures 1 & 2 in accordance <br /> with the requirements of National Pollutant Discharge Elimination Systems <br /> ("NPDES") Phase II, and declaring an emergency. This Resolution renews a <br /> Memorandum of Understanding with the SWCD. Wenger explained that the <br /> compliance with the minimum control measures are required under state law, and <br /> the SWCD has performed satisfactory education and training to be in compliance <br /> with these measures in the past, and executed these services at the lower price and <br /> higher quality than the city would provide internally. The cost of the SWCD's <br /> services is $5,500. The committee voted 2-0 to recommend approval of <br /> Resolution 2014-14. The meeting was adjourned at 7:57 p.m. <br /> Councilwoman Hemann announced a seminar for Fair Lending sponsored by the Housing <br /> Research and Advocacy Center on Saturday February 22, 2014 at the North Olmsted <br /> Library at 10:00 a.m. until 11:00 a.m. <br /> AUDIENCE PARTICIPATION <br /> Dennis Lambert, 25057 Carey Lane said he was impressed by the Finance Committee <br /> report this evening, and it was probably one of the best reports he has heard. He asked <br /> about the grant for LED street lights and where the matching funds of close to $2 million <br /> is in the budget. Copfer said the design was in the budget last year—they borrowed for it <br /> — but the designing continues and will not be until 2015 when they do the project. <br /> Lambert asked if the cost will still be the same in 2015. Copfer said she does not know <br /> the answer for sure, but the cost projections are what the cost is expected to be. Lambert <br /> asked if the grant will be extended to cover additional costs at that time, or is the city <br /> stuck with an $8 million grant and a $10 million project that might require $4 million <br /> worth of matching funds. Copfer said she does not have the answer to that. He asked if <br /> there is a chance to back out of the project, and Copfer said she does not know. <br /> Councilman Barker said the project isn't just LED lights, it covers the entire traffic <br /> signalization system and technology. Councilman Schumann said this also includes <br /> emergency signalization. <br /> Don Pagrace, 23470 Sharon Drive said he counted street lights that were not lit this <br /> evening on his way to City Hall. There were 13 lights out on Lorain from Dover Center <br /> to Clague. He brought this up to the Safety/Service Director in October 2013. Why are <br /> 13 lights still out? Mayor Kennedy said lights that are out have been reported to First <br /> Energy. The city is not responsible for street lights, First Energy is. <br /> Jeff Sturgeon, 3092 W. 231 referenced the hotel that is to be constructed by Moen, and <br /> asked why there is a court order regarding the zoning. Gareau said in the 1980's, there <br /> were a number of lawsuits filed concerning the constitutionality of zoning classifications <br /> brought by property owners seeking commercial development.
