CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2014 — 53 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 941.04 OF CHAPTER 941 OF <br />THE STREETS, UTILITIES AND PUBLIC SERVICES CODE ENTITLED <br />"REFUSE COLLECTION" IN ORDER TO UPDATE STANDARDS FOR <br />COLLECTION OF RECYCLABLE MATERIALS. <br />WHEREAS, the City of North Olmsted in 2011 and 2012 phased in a new and revised <br />system of refuse collection by and through the use of automated collection; and <br />WHEREAS, in 2012, the City of North Olmsted updated its procedures for collection of <br />refuse and recyclable materials; and <br />WHEREAS, given the change in recycling processes including the type of materials <br />suitable for recycling, it is the recommendation of the Administration that the City update its <br />ordinance concerning recycling collection; <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration, to establish revised recycling standards within the City. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 941 "Refuse Collection" which presently reads in its entirety <br />as follows: <br />941.04 PLACEMENT AND COLLECTION OF RECYCLABLE MATERIALS. <br />Occupants of single family or multi- family residential structures shall place cardboard, boxes, <br />newspapers, junk -mail, magazines, cereal boxes, glass bottles and jars of any color, steel cans <br />and numbers 1 and 2 stamped plastics in containers acceptable to the Director of Public Service <br />and these materials shall be placed within the public right of way for collection. As defined for <br />purposes of this section, the public right of way appropriate for placement and collection of <br />recyclable materials shall be limited to curbside tree lawns. Such recyclable materials shall be so <br />placed in the public right of way no earlier than the evening preceding collection by the City of <br />the street which the tree lawn or other area abuts. The date or day for collection of recyclable <br />materials for an occupants of single family or multi - family residential structures shall correspond <br />to the date or day of collection of garbage or rubbish. <br />Upon the placement of recyclable materials in accordance with this section, said materials <br />become the property of the City. <br />
