Once recyclable materials are placed for collection in accordance with this section, no person, <br />other than authorized City or City contractor personnel, shall remove said recyclable material. <br />Any and each collection or removal of unauthorized persons in violation of the provisions of this <br />section, from one or more designated collection places, shall constitute a separate and distinct <br />offense. For each separate offense, the individual shall be guilty of a minor misdemeanor and be <br />fined not more than one hundred dollars ($100.00). <br />Shall be amended and, as amended, shall read as follows: <br />941.04 PLACEMENT AND COLLECTION OF RECYCLABLE MATERIALS. <br />Occupants of single family or multi - family residential structures shall place cardboard, boxes, <br />newspapers, junk -mail, magazines, cereal boxes, glass bottles and jars of any color, steel cans <br />and numbers 1 and 2 through 7 stamped plastics in containers acceptable to the Director of <br />Public Service and these materials shall be placed within the public right of way for collection. <br />As defined for purposes of this section, the public right of way appropriate for placement and <br />collection of recyclable materials shall be limited to curbside tree lawns. Such recyclable <br />materials shall be so placed in the public right of way no earlier than the evening preceding <br />collection by the City of the street which the tree lawn or other area abuts. The date or day for <br />collection of recyclable materials for an occupants of single family or multi- family residential <br />structures shall correspond to the date or day of collection of garbage or rubbish. <br />Upon the placement of recyclable materials in accordance with this section, said materials <br />become the property of the City. <br />Once recyclable materials are placed for collection in accordance with this section, no person, <br />other than authorized City or City contractor personnel, shall remove said recyclable material. <br />Any and each collection or removal of by unauthorized persons in violation of the provisions of <br />this section, from one or more designated collection places, shall constitute a separate and <br />distinct offense.
