15.8 If the employee fails to submit adequate proof of illness, injury or death, or in the event <br />that upon proof as is submitted or upon the request of medical examination, the Employer finds <br />there is not satisfactory evidence of illness or death sufficient to justify the employee's absence, <br />such leave may be considered an unauthorized leave and shall be without pay. <br />15.9 Any abuse or patterned use of sick leave shall be just and sufficient cause for disciplinary <br />action, including discharge. <br />l 5.10 Employees shall be permitted to contribute sick leave hours to a sick leave bank for use <br />by any employee who has exhausted all of his own sick leave under the following conditions: <br />A. The Sick Leave bank shall have a maximum balance of fifteen hundred (1500) <br />hours. <br />B. Employees that have suffered any illness or injury in the scope of their <br />employment and have exhausted the benefits of Article XVII or were not covered <br />by the provisions of Article XVII may draw from the sick leave bank after their <br />own sick leave bank has been exhausted. <br />C. Employees that have suffered any illness or injury to themselves or their <br />immediate family outside of the scope of their employment may draw from the <br />sick leave bank only after the employee has exhausted all of their own sick leave <br />bank, vacation and holidays. <br />D. Any employee that contributes sick leave hours to the sick leave bank shall not <br />lose any sick leave bonus as granted by section 15.2. <br />E. No employee shall be permitted to contribute more than one hundred 0 00) hours <br />during his term of employment. <br />F. Employees who have used hours from the sick leave bank shall be required to <br />repay the sick leave bank one (1) hour for every two (2) hours used. Employees <br />shall be required to repay a minimum of two (2) hours per pay period. Should an <br />employee not be able to repay the sick leave bank prior to his separation from <br />service then the sick leave bank shall be credited from his separation check. Such <br />requirement of repayment may be waived by a majority vote of the Association's <br />Executive Board of Local 1267, the Chief and Assistant Chief. <br />ARTICLE XVI LEAVE OF ABSENCE <br />16.1 In addition to medical leaves to which they may be entitled to under the Family Medical <br />Leave Act ( "FMLA "), employees may be entitled to take a personal leave of absence with the <br />approval of the Fire Chief. Any leave of absence for personal reasons shall not exceed a ninety <br />(90) day period. If the personal leave of absence is for an event which qualifies for medical leave <br />18 <br />
