E. Suspend, discipline, demote, or discharge for just cause, or lay, off, transfer, <br />assign, schedule, promote, or retain employees; <br />F. Determine adequacy of the work force; <br />G. Determine the overall mission of the Employer as a unit of government; <br />H. Effectively manage the work force; <br />L Take actions to carry out the mission of the public Employer as a governmental <br />unit. <br />The employer is not required to bargain on subjects reserved to the management and <br />direction of governmental unit except as affect wages, hours, terms and conditions of <br />employment, and the continuation, modification, or deletion of an existing provision of a <br />collective bargaining agreement. A public Employee or exclusive representative may raise <br />legitimate complaint or file grievance based on the collective bargaining agreement. <br />ARTICLE V DUES DEDUCTIONS <br />5.1 The Employer agrees to deduct regular monthly Association dues from wages of those <br />employees who have voluntarily signed dues deduction authorization forms permitting such <br />deductions. The dues deductions shall be made from the second paycheck of every month. <br />5.2 The Employer agrees to deduct from the salary of any, employee, who is not a member of <br />the Association, to pay to the Association by way of payroll deduction, a Fair Share Fee, as <br />determined by the Treasurer of the Association but not to exceed the dues paid by Association <br />members. <br />5.3 A check in the amount of the total dues and Fair Share Fees withheld from those <br />employees authorizing dues and Fair Share Fee deductions shall be tendered to the Treasurer of <br />the Association within fourteen (14) days from the date of those deductions. The Employer shall <br />supply the Association with a list of those employees for whom deduction has been made. <br />5.4 The Association agrees to hold the Employer harmless from any and all liabilities and <br />damages which may arise from the performance of its, the Employer's, obligations under this <br />Article and the Association shall indemnify the Employer for any such liabilities or damages that <br />do arise. <br />ARTICLE VI NONDISCRIMINATION <br />6.1 The parties to this Agreement agree to continue their policy of non - discrimination as <br />required by applicable law based on sex, race, religion, disability, national origin, color or age, <br />regarding employment, employment advancement, working conditions, rates of pay, acceptance <br />into Association membership or selection for apprentice openings. <br />
