MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />DECEMBER 2, 2014 <br />Present: Council President Jones, Council Members Barker, Brossard, Hemann, <br />Kearney, Limpert and Schumann <br />Also Present: Mayor Kennedy, Director of Law Gareau, Director of Finance Copfer, <br />Clerk of Council Gallo and Director of Safety /Service Glauner and <br />Director of Planning /Development Wenger <br />Absent: Council Member Williamson <br />Director of Human Resources Farver <br />Council President Jones called the meeting to order at 8:00 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />The Council meeting minutes of November 18, 2014 were approved as written. <br />The following legislation will be considered for passage under suspension of the rules <br />this evening: Second Reading — Resolutions 2014 -81 and 2014 -82; First Reading — <br />Resolution 2014 -90. <br />REPORTS <br />Mayor Kennedy: <br />• He thanked Council members for attending the Tree Lighting Ceremony. He also <br />thanked Planning /Development Director Wenger and the Arts Commission for <br />organizing it. <br />Director of Law Gareau: <br />• He gave a brief update on the court case Brian Bielozer vs. The City of North <br />Olmsted. This week, the city prepared and filed with the court a defendant's <br />motion to dismiss counts 7, 8, 9, 11 and all claims against defendants Victor <br />Branscum, Cheryl Farver and Lisa Kidd. This is an amended complaint that was <br />originally filed to dismiss several other counts. They also filed an answer to the <br />amended complaint for the City of North Olmsted, Jamie Gallagher Charles <br />Fioritto, Ronald Cox and Scott Thomas. The discovery period for that case is <br />coming to a conclusion and the deadline was the other day. In addition to this <br />motion, he would expect a number of different motions filed within the next 30 to <br />45 days seeking to dispose of most of the claims that are pending against the city <br />and the named defendants. <br />Director of Finance Copfer: <br />
