1319.07 CANCELLATION OF LICENSE; NOTIFICATION. <br /> The Building Commissioner may cancel any license issued hereunder and withdraw a <br /> certificate of occupancy for any rental unit when a violation of a State law, the Fire Prevention <br /> Code, or City ordinance has been found to exist on the premises in excess of thirty days after <br /> notice has been sent to the owner of such rental unit. Notification for the purpose of this section <br /> shall be by certified or registered mail to the owner at the address shown on the application <br /> required by Section 1319.04 or, if no application has been filed, by the Cuyahoga County tax <br /> duplicate records. <br /> Notwithstanding the requirement of notice provided herein, when in the opinion of the <br /> Building Commissioner the condition of the structure or premises, or a part thereof, constitutes <br /> an immediate hazard to human life or health, or when a prior violation notice has been sent to the <br /> owner or agent for the same or similar violation,then no such notice of violation need be given <br /> to the owner or agent of the structure containing a rental unit. <br /> 1319.08 APPEALS. <br /> In case the Building Commissioner refuses to issue a license or cancels or suspends a <br /> license,the applicant may appeal from such order to the Board of Building Code Appeals. The <br /> procedure for such appeal shall be consistent with Chapter 1315 of the North Olmsted Codified <br /> Ordinances. <br /> 1319.09 MAINTENANCE REQUIREMENTS. <br /> All structures and premises containing rental units and all parts thereof, both exterior and <br /> interior, shall be maintained by the owner or owner's agent in good repair and shall be capable of <br /> performing the function for which such structures or part of any feature thereof was designed or <br /> intended to be used. Standards for exterior and interior maintenance are described in Chapters <br /> 1363 and 1364, respectively. <br /> 1319.10 CONFLICT. <br /> In the event of conflict between any provisions of this chapter, including any rules and <br /> regulations adopted pursuant to this chapter, and any provisions of the ordinances of the City, <br /> including any rules and regulations adopted pursuant to such ordinances, the more restrictive <br /> provisions shall prevail. <br /> 1319.99 PENALTY. <br /> (a) Any person, firm or corporation or agent thereof who violates any provision of <br /> this chapter is guilty of a misdemeanor of the fourth degree for the first offense. For each <br /> subsequent offense, such person is guilty of a misdemeanor of the first degree. Each day's <br /> violation shall be deemed a separate offense. <br /> (b) The imposition of any penalty shall not preclude the Director of Law from <br /> instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an <br /> unlawful repair or maintenance; or to restrain, correct or abate a violation, or to prevent the <br /> occupancy of a building, structure or premises, or to require compliance with the provisions of <br /> this Code, or other applicable laws, ordinances, rules or regulations. <br />
