ti TERMS OF CONTRACT EFFECTIVE DATE The Contract will be effective upon the execution of the contract and performance of such contract shall become effective sixty (60)days after award of Bid. The effective date may be modified by mutual agreement of the City and Contractor. NON-DISCRIMINATION The Contractor shall not discriminate against any person because of race, sex, age, creed, color, religion or national origin. INDEMNITY The Contractor will indemnify, save harmless and exempt the City, its officers, agents, servants and employees from and against any and all suits, actions, legal proceedings, claims,demands, damages, costs,expense and attorney fees incident to any work done in the performance of this Contract arising out of a willful or negligent act or omission of the Contractor, its officers,agents,servants and employees. INSURANCE For the purpose of the Contract,the Contractor shall carry the following types of insurance in at least the limits specified below: COVERAGES LIMITS OF LIABILITY Workers' Compensation Statutory Bodily Injury Liability $1,000,000 each occurrence Except Vehicular $1,000,000 each aggregate Property Damage Liability $500,000 each occurrence Except Vehicular $500,000 each aggregate Vehicular Bodily Injury $1,000,000 each person Liability $1,000,000 each occurrence Vehicular Property $500,000 each occurrence Liability Excess Umbrella Liability $5,000,000 each occurrence BOND/AFFIDAVIT Performance Bond The Contractor will be required to furnish a corporate surety bond as security for the performance of this Contract. Said surety bond must be in the amount of 100%of the Contract amount and may provide a pro-rate reduction therein annually over the term of the Contract.
