CV 127076 <br /> ) <br /> Plaintiffs, ) JUDGE <br /> v. ) <br /> ) JOINT MOTION AND <br /> CITY OF NORTH OLMSTED, OHIO, ) STIPULATION FOR <br /> ET AL., ) MODIFICATION OF JUDGMENT <br /> ) ENTRY TO DESCRIBE <br /> Defendants. ) PERMITTED PROPERTY USES <br /> ) <br /> Now come all parties, through undersigned counsel, and jointly move this Court to <br /> accept the following stipulations and to approve the attached Journal Entry to permit <br /> Modification of this Court's initial Judgment Entry dated November 23, 1988 and the subsequent <br /> Modification of Judgment Entry dated November 2, 1992 (Volume 1559, Page 0397-0400). <br /> Generally, as to the history of this land use dispute, the parties resolved the Plaintiffs' <br /> challenge to the Defendant's zoning designation by designated parcel map permitting specific <br /> commercial and multi-family uses of the property, located south of I-480 on State Route 252, <br /> Great Northern Blvd. The first parcel developed as multi-family residential pursuant to the <br /> settlement in 1988. In 1992 the parties' jointly requested modification of the parcel designation <br /> map to enable the development of the Moen office building on land previously designated for <br /> hotel use. This Court granted modification of the Judgment accordingly. Thus, as before, the <br /> parties again jointly request the Court to permit modification of the Judgment Entry and <br /> amendment of the parcel designation map accordingly. <br /> 1 <br />
