The parcel designated as 1A, Revised, 11.7206 acres pursuant to Resubdivision Plat <br /> dated 10-28-1992, as Recorded in Cuyahoga County Records at Volume 260, Page 88, has <br /> remained undeveloped since 1992. Plaintiff has prepared, and the City of North Olmsted has <br /> reviewed and approved, a development plan for the construction of an Aloft hotel on a parcel <br /> presently designated for office use only. The parties incorporate by reference the Resubdivision <br /> Plat dated October 28, 1992, as recorded at Volume 260, Page 88 of Cuyahoga County Records <br /> for purposes of designation and description of Parcels 1 A, 1B and 1C as platted on Al Moen <br /> Drive,North Olmsted, Ohio. <br /> The parties stipulate, except to the extent specifically modified herein, that the terms and <br /> conditions of this Court's initial Judgment Entry and subsequent Modification shall remain in <br /> full force and effect. <br /> The parties further stipulate and intend that Parcel 1 A, as previously designated for office <br /> use only, shall be expanded to also include a hotel use, with such use and development to be in <br /> conformity with the development plan approved by the City Council of the City of North <br /> Olmsted on the day of , 2015 and on file with the Division of Building in the <br /> City of North Olmsted. See also, Exhibit A, attached hereto. The hotel shall be in compliance <br /> with licensing and building requirements in Revised Code Chapter 3731. The hotel shall be <br /> designed, constructed and licensed as a "Transient Hotel" and not as a "Single Room Occupancy <br /> (SRO)" or as an"Extended Stay Hotel" all as defined in R.C. §3731.01(A)(2). <br /> The parties further stipulate and intend that Parcel 1A, as previously designated for office <br /> use only, shall be expended to also include a restaurant use. <br /> 2 <br />
