(c) The notice specified in subsections (a) and (b) hereof shall be by regular first class mail <br />postage prepaid, mailed at least five days prior to the date of such meeting. <br />(d) For purposes of this section "independent record title holder," except as otherwise <br />specifically provided herein for condominium property, means a person, who as disclosed by the <br />records of the Auditor of the County, is the owner at any date within sixty days of the date of <br />such notice. For condominium property, "independent record title holder" means the <br />condominium homeowners association for the condominium property, as disclosed by the <br />records of the Auditor or Recorder of the County. Notice to a condominium homeowners <br />association shall be deemed sufficient if, after reasonable efforts to ascertain the identity of the <br />president and secretary of the association, it is addressed to the president and secretary of the <br />association and mailed to their addresses if so ascertained. Notwithstanding the foregoing <br />provision and in lieu of the same, notice to a condominium homeowner's association shall be <br />deemed sufficient if served upon the agent for service of process as identified in those documents <br />on file with the Ohio Secretary of State. <br />(e) Nothing herein provided shall be construed as limiting the power of the Commission from <br />enlarging on such notice, nor be construed as prohibiting the Clerk of Commissions from <br />providing separate or additional notification upon the request of the Commission or any citizen. <br />BE AMENDED AND, AS AMENDED, SHALL READ AS FOLLOWS: <br />149.02 NOTICE OF MEETINGS. <br />(a) The Clerk of r,....,..;sA, m A secretary assigned by the Director of Planning and <br />Development (hereinafter "Secretary") shall be required to send notification of Planning and <br />Design Commission meetings giving the time, date and subject matter of the meeting to the <br />independent record title holder of property affected by any proposed subdivision or development. <br />For the purposes of this section those interested parties affected by any subdivision or <br />development shall be as follows: <br />(1) Those on the same side of the street which abut the premises involved; <br />(2) Those across the street immediately opposite the premises involved; <br />(3) Any other premises abutting the premises involved; and <br />(4) Such other premises as may be ordered to be notified by rule or regulation of the <br />Commission or by its special order. <br />(b) The Secretary shall be required to send notification of Planning and Design Commission <br />meetings giving the time, date and subject matter of the meeting to the independent record title <br />holder of property affected by any proposal to initiate or recommend the initiation of an <br />amendment of the Zoning Map, in conjunction with a subdivision or development plan, or <br />otherwise to request rezoning. For the purposes of this section, those interested parties affected <br />by any rezoning shall be all record title holders of real property, located within one thousand <br />(1,000) feet of the property, area, zone or district proposed to be changed within the boundaries <br />of North Olmsted. <br />(c) The notice specified in subsections (a) and (b) hereof shall be by regular first class mail <br />postage prepaid, mailed at least five days prior to the date of such meeting. <br />2 <br />
