(d) For purposes of this section "independent record title holder," except as otherwise <br />specifically provided herein for condominium property, means a person, who as disclosed by the <br />records of the Auditor of the County, is the owner at any date within sixty days of the date of <br />such notice. For condominium property, "independent record title holder" means the <br />condominium homeowners association for the condominium property, as disclosed by the <br />records of the Auditor or Recorder of the County. Notice to a condominium homeowners <br />association shall be deemed sufficient if, after reasonable efforts to ascertain the identity of the <br />president and secretary of the association, it is addressed to the president and secretary of the <br />association and mailed to their addresses if so ascertained. Notwithstanding the foregoing <br />provision and in lieu of the same, notice to a condominium homeowner's association shall be <br />deemed sufficient if served upon the agent for service of process as identified in those documents <br />on file with the Ohio Secretary of State. <br />(e) Nothing herein provided shall be construed as limiting the power of the Commission from <br />enlarging on such notice, nor be construed as prohibiting the Secretary Clerk of G <br />from providing separate or additional notification upon the request of the Commission or any <br />citizen. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for that <br />reason this legislation must go into effect immediately in order to comply with Charter <br />Amendments currently in effect; and further provided it receives the affirmative vote of two- <br />thirds of all members of Council, it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor. <br />PASSED: l First Reading: 011e lyt <br />Second Reading: <br />Third Reading: _6' Ll <br />Committee: 6;q a JA te__. <br />AT EST: <br />r <br />RIE GA LO <br />Clerk of Council <br />APPROVED: !S // )116 <br />3 <br />NICOLE DAIL Y JON <br />President of Council <br />APPROVED AS TO LEGAL FORM - <br />
