CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 — 60 <br />BY: Mayor Kennedy <br />AN ORDINANCE DISPENSING WITH A FORMAL RFP PROCESS AND <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH <br />HAZEN AND SAWYER, P.C. TO PERFORM A SEWER RATE STUDY <br />AND RELATED PROFESSIONAL SERVICES FOR THE CITY OF <br />NORTH OLMSTED IN ORDER TO EVALUATE FUNDING SOURCES <br />AND ORDINANCES FOR THE WASTEWATER TREATMENT PLANT <br />AND COLLECTIONS SYSTEM, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council last addressed sewer rates, based upon a sewer rate study, by <br />adoption of Ordinance No. 2011-74, amending rates imposed by Code Chapter 915; <br />WHEREAS , the City had previously adopted Ordinance No. 2005-167 authorizing <br />the Director of Public Service to request proposals from qualifying consulting engineer firms <br />to conduct a rate and operations study of the North Olmsted Wastewater Treatment Plant and <br />Collections System; and <br />WHEREAS, the City's Board of Control had, based on said RFP, previously awarded <br />a contract to ATS Engineering, Inc., a predecessor of Hazen and Sawyer, P.C., as the firm <br />most qualified to conduct the rate and operations study for the City; and <br />WHEREAS, based on the recommendations of the Administration and ATS <br />Engineering, Inc., this Council, on November 20, 2007, adopted Ordinance No. 2007-123, <br />which provided for an increase in user charges effective January 1, 2008; and <br />WHEREAS, since April of 2009, Hazen and Sawyer, P.C. is the assignee/successor <br />entity to ATS Engineering, Inc. and has been engaged by the City to perform engineering <br />design services for the renovations and reconstruction of the Waste Water Treatment Plant <br />and Collection Systems; and <br />WHEREAS, Section 111.08 of the Administrative Code provides that personal <br />services, including professional services, may be obtained by the City without following the <br />formal RFP process established by Section 111.03 et seq. of the Administrative Code, when it <br />is beneficial to do so due to a continuing relationship between the City and a professional <br />services provider; and <br />WHEREAS, it is accordingly the recommendation of the Director of Public Service <br />and the desire of this Council, in light of the continuing professional relationship between the <br />City and Hazen and Sawyer, P.C., to dispense with the RFP process and authorize the Mayor <br />to enter into a contract with Hazen and Sawyer. P.C., for the purpose of providing the sewer <br />rate study and other related professional services needed for the evaluation of Ordinances <br />which provide funding sources for the Wastewater Treatment Plant and Collections System; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />
