SECTION 1: That the formal RFP process required by Sections 111.03 et seq. of the <br />Administrative Code is hereby dispensed with by reason of the continuing professional <br />relationship between the City and Hazen and Sawyer, P.C., and the Mayor be and he hereby is <br />authorized to enter into a contract with Hazen and Sawyer, P.C., to provide for the sewer rate <br />study and other related professional services for the evaluation of Ordinances and funding <br />sources for the North Olmsted Wastewater Treatment Plant and Collections System. <br />SECTION 2: That said contract shall be based upon, in substance, and substantially <br />the same as the Rate Analysis Update Proposal attached to this Ordinance as "Exhibit A," to <br />which is attached the proposal of Hazen and Sawyer, P.C., dated April 8, 2016, with such <br />changes thereto in the form and substance of the Agreement and Proposal that are not <br />substantially adverse to the City. The character of any such changes as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the Agreement by the <br />Mayor and the approval of the Agreement by the Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for <br />that reason this legislation must go into effect immediately in order to provide sufficient time <br />to amend the sewer rate ordinance currently in effect; and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />r <br />PASSED:uGu <br />ATTEST: <br />A,rA,IrIA GALLO <br />Clerk of Council <br />APPROVED: J U Vy �_ :], v2 0 I U <br />2 <br />MA F0kkEVIN M.
