SECTION 1: That the formal RFP process required by Sections 111.03 et seq. of the Administrative Code is hereby dispensed with by reason of the continuing professional relationship between the City and Hazen and Sawyer, P.C., and the Mayor be and he hereby is authorized to enter into a contract with Hazen and Sawyer, P.C., to provide for the sewer rate study and other related professional services for the evaluation of Ordinances and funding sources for the North Olmsted Wastewater Treatment Plant and Collections System. SECTION 2: That said contract shall be based upon, in substance, and substantially the same as the Rate Analysis Update Proposal attached to this Ordinance as "Exhibit A," to which is attached the proposal of Hazen and Sawyer, P.C., dated April 8, 2016, with such changes thereto in the form and substance of the Agreement and Proposal that are not substantially adverse to the City. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for that reason this legislation must go into effect immediately in order to provide sufficient time to amend the sewer rate ordinance currently in effect; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor. r PASSED:uGu ATTEST: A,rA,IrIA GALLO Clerk of Council APPROVED: J U Vy �_ :], v2 0 I U 2 MA F0kkEVIN M.
