CITY OF NORTH OLMSTED ORDINANCE NO. 2016 — 36 By: Mayor Kennedy AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER ELEVEN OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED TITLED "PLANNING AND ZONING CODE" FOR THE PURPOSE OF CHANGING THE "BOARD OF ZONING APPEALS" TO THE "BUILDING AND ZONING BOARD OF APPEALS" AND FOR THE FURTHER PURPOSE OF ELIMINATING REFERENCE TO THE DEFUNCT ARCHITECTURAL REVIEW BOARD. WHEREAS, the electors of the City of North Olmsted in November of 2015 approved a proposed amendment to the Charter of the City of North Olmsted to merge the Board of Building Code Appeals and the Board of Zoning Appeals to form a new Building and Zoning Board of Appeals; and WHEREAS, multiple sections of the Planning and Zoning Code make reference to the now abolished Board of Zoning Appeals; and WHEREAS, the Architectural Review Board was abolished via Ordinance 2005-165, passed January 16, 2007; and WHEREAS, it is the recommendation of the Director of Planning and Development and the Director of Law that the Planning and Zoning Code be amended to substitute the newly enacted Building and Zoning Board of Appeals for the Board of Zoning Appeals; WHUREAS, after careful consideration, the Planning and Design Commission of the City, on the day of ;_, 2016, by formal motion, recommended this Ordinance amending the following sections: 1101.02(e); 1101.07(d)(3); 1115.02(5) & (71); 1115.07(d); 1117.02(a); 1121.99(a); 1126.04(c) & (d); 1141.02(b); 1145.03(f)(1); 1163.08; 1165.02(b)(1); and 1165.03(a); 1115.02(28), (69) & (71); 1151.05(b)(2) and (d)(2); and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Zoning Code, a public hearing was held on the.�,/A day of a , 2016; and WHEREAS, it is the desire of this Council to amend the Code in order to conform with the recent Charter Amendment by amending the Planning and Zoning Code of the City of North Olmsted.
