CITY OF NORTH OLMSTED ORDINANCE NO. 2016 —118 BY: Mayor Kennedy AN ORDINANCE AMENDING SECTIONS 8 AND 9 OF ORDINANCE NO. 2002-103 WHICH, INTER ALTA, ESTABLISHED FEES AND CHARGES FOR EMERGENCY MEDICAL SERVICES RENDERED BY THE NORTH OLMSTED FIRE DEPARTMENT, IN ORDER TO PROVIDE FOR THOSE REVENUES RECEIVED FOR ALL SERVICES RENDERED TO BE PAID FIFTY PERCENT (50%) INTO THE GENERAL FUND AND FIFTY PERCENT (50%) INTO THE EMERGENCYMEDICAL SERVICES FUND. WHEREAS, in 2002 Council adopted Ordinance No. 2002-103, which, inter alfa, established fees and charges for emergency medical services rendered by the North Olmsted Fire Department, and designated the funds into which revenues received from services rendered to residents as well as non-residents were to be paid (one hundred percent (100%) of revenue from non-residents to Hotel Motel Tax Fund; seventy-five Percent (75%) of revenue from residents to General Fund; and twenty-five Percent (25%) of revenue from residents to the Emergency Medical Services Fund); and WHEREAS, in 2002 Council adopted Ordinance No. 2002-154, which amended the fee schedule (Section 3) of Ordinance No. 2002-103; and WHEREAS, facing an economic downturn in 2008, Council amended Section 8 of 2002- 103 for the purpose of directing that one hundred percent (100%) of funds received from Emergency Medical Services rendered to residents and non-residents be directed into the General Fund; and WHEREAS, in order to provide for a sustaining fund from which to make capital purchases for emergency medical service facilities and equipment, it is the recommendation of the Mayor and the Director of Finance that fifty percent (50%) of the revenue received for providing emergency medical services be paid into the General Fund and that fifty percent (50%) of the revenue received for providing emergency medical services be paid into the Emergency Medical Services Fund; and WHEREAS, it is the desire of this Council, acting upon the recommendation of the Administration, to accordingly amend Sections 8 and 9 of Ordinance No. 2002-103, as previously amended by Ordinance Nos. 2002-154 (fee schedule) and 2008-95 (allocation of revenue), to provide that fifty percent (50%) of the revenue received for emergency medical services provided be paid into the General Fund and that fifty percent (50%) of the revenue received for emergency medical services provided be paid into the Emergency Medical Services Fund. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO:
