MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />DECEMBER 20, 2016 <br />Present: Council President Jones, Council Members Barker, Brossard, Hemann, <br />Kearney, Limpert, Schumann & Williamson <br />Also Present: Mayor Kennedy, Director of Finance Copfer, Human Resources Director, <br />Gallo, Director of Law Gareau, Director of Safety & Service Glauner, <br />Clerk of Council Massarolo, and Director of Planning & Development <br />Wenger <br />Council President Jones called the meeting to order at 8:00 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />The Council meeting minutes of December 6, 2016 were approved as written. <br />The following legislation will be considered for passage under suspension of the rules <br />this evening: Second Reading — Ordinance 2016-133, Ordinance 2016-138 and <br />Ordinance 2016-139. First Reading — Ordinance 2016-140 and Resolution 2016-141. <br />REPORTS <br />Mayor Kennedy: <br />• Wished everyone a Merry Christmas and Happy New Year <br />Director of Law Gareau: <br />In the Matter of Virginia Sopko v. James Saumer and the City of North Olmsted. <br />There are two issues to discuss. The first is Mr. Saumer was found guilty in <br />Rocky River Municipal Court and was given the opportunity to abate at least <br />some of the nuisance and has failed to do so. He is currently incarcerated for a <br />period of 20 days based on that ongoing violation. Secondly, there is a civil <br />lawsuit currently going on as a result of this same piece of property and the owner <br />has brought an action against the City and Mr. Saumer. He is not seeking damages <br />against the City, he is seeking to assert his rights to the property. However, the <br />City is seeking our money back for all the time spent cleaning and maintaining it. <br />The City did file an answer and will be proceeding in the Court of Common Pleas. <br />Some of you are familiar with the massage establishment on Lorain Road on the <br />east side of town located at 23132. It goes by a number of different names such as <br />Lorain Relax, Lorain Reflex, it has had a bunch of different names. The City has <br />prosecuted the individual that is running the establishment. Notwithstanding being <br />shutdown, he has reopened thinking he has found some crazy way around the law. <br />The City disagrees. The City is going to be bringing a civil action to shut him <br />down as well as to continue to prosecute him and anyone that wants anything to <br />do with the company unless they decide to comply with our laws. <br />
