Development Plan Review <br />C. Conditions of Approval. Conditions which are designed to ensure compliance with the <br />intent of this ordinance and other regulations of the City may be imposed during <br />development plan approval. Conditions imposed shall be based on the following criteria: <br />1. To ensure that public services and facilities will not be adversely affected. <br />2. To ensure that the use is compatible with adjacent land uses and activities. <br />3. To protect the health, safety, welfare and social and economic well-being of those who <br />will use the land use or activity under consideration, residents and landowners <br />immediately adjacent to the proposed land use or activity and the community as a whole. <br />4. To protect natural resources and the environment. <br />5. To ensure compatibility between the proposed use or activity and the rights of the City to <br />perform its governmental functions. <br />6. To meet the intent and purpose of the Zoning Code and Master Plait <br />7. To be related to the regulations and standards established in the ordinance for the land <br />use or activity under consideration and be necessary to ensure compliance with those <br />standards. <br />8. To ensure compliance with the intent of other City ordinances that are applicable to the <br />development plan. <br />Section 1126.08 Amendments to Development Plans <br />A. Amendments. Amendments to an approved development plan shall be permitted only <br />where the holder of an approved development plait notifies the,,Planning and Development <br />Director of any proposed changes. A revised development plan shall be submitted to the <br />Planning and Development Director for review as provided in Subsection B and contain a list <br />of all proposed amendments and changes and shall be indicated on the site plans. <br />B. Reviewing Authority. <br />1. Changes to an Administrative Review Plan. Proposed changes to a development plan <br />approved administratively. may be approved by the Planning and Development Director. <br />2. Changes to a City Council''''' Review Plan. Proposed changes to a development plan <br />approved by City Council shall ,be reviewed as follows: <br />a. Minor Changes. Mihor,',ghanges maybe approved by the Planning and Development <br />Director uppn determining z that the proposed revision(s) will not alter the basic design <br />and character of the°development plan, nor any specified conditions imposed as part <br />of the original approval. Minor changes shall include the following: <br />I., Reduction in size of any building and/or other structures. <br />ii. Movement of buildings or other structures by no more than ten (10) feet. <br />iii. Landscaping approved on the development plan that is replaced by similar <br />landscaping to an equal or greater extent. <br />iv. Changes in building materials to a comparable or higher quality material. <br />v. Internal re -arrangement of a parking lot that does not affect the number of <br />parking spaces or alter access locations or design. <br />vi'`' Changes related to Subsections i -v above, required or requested by the City or <br />County, State, or federal regulatory agency in order to conform to other laws or <br />regulations, provided such changes do not alter the basic design and character <br />of the plan, nor any specified conditions imposed as part of the original approval. <br />b. Major Changes. Major changes are changes that fall outside the scope of minor <br />changes as defined in this section as determined by the Planning and Development <br />Director.
